Justification for the duration of the framework agreement: Eine vier Jahre überschreitende Laufzeit ist gemäß § 154 Abs. 5 BVergG 2018 sachlich gerechtfertigt, da für den Auftraggeber im Rahmen der Umstellung auf einen neuen Auftragnehmer bzw. neue Leistungen ein hoher Initialaufwand bzw. ein erhöhtes Fehlerpotential entsteht, weshalb zu häufige Wechsel vermieden werden müssen. Dieser Aufwand besteht insbesondere aus Übergangsfristen bei Lieferantenwechseln und höheren Investitionsanschaffungen des zukünftigen Auftragnehmers sowie der eventuellen Neuanschaffung von Flaschenpools und Tanks einschließlich deren Vorfinanzierung. Relevant in diesem Zusammenhang ist insbesondere die Abschreibungsdauer der Anlagen.
