Additional information: Accord-cadre conclu pour une durée d'un an reconductible 3 fois un an. Toutefois, en cas d'atteinte du montant maximum de l'accord-cadre avant la fin de la période en cours, la reconduction peut être anticipée par décision expresse du Cned. L'anticipation d'une période ne peut avoir pour conséquence d'en augmenter le nombre. La durée totale de l'accord-cadre est égale à la somme des 4 périodes quelle que soit leur durée réelle. En application de l’article R.2122-7 du Code de la commande publique, le Cned se réserve la possibilité de conclure avec le titulaire, des marchés sans publicité ni mise en concurrence préalable ayant pour objet la réalisation de prestations similaires. Accord-cadre mono attributaire en vertu des articles L2125-1 1° et R.2162-1 à R.2162-14 du Code de la commande publique, comportant : - principalement des bons de commande, pour les formations listées au CCTP et les prestations d’ingénierie en vue d’adaptation de formations sur étagère ; - des marchés subséquents, pour des formations non prévues au CCTP. Les variantes ne sont pas autorisées. Afin de promouvoir la diversité et combattre l’exclusion, le Cned souhaite mobiliser les entreprises dans le cadre de sa politique d’achats responsables. En application de l’article L.2112-2 du Code de la commande publique, les candidats répondant aux lots 1, 2 et 6 doivent obligatoirement proposer une action permettant la formation d’un ou plusieurs élèves à besoins spécifiques, de 16 à 25 ans, suivi par un référent du ministère de l’Education nationale (enseignant, CPE, référent décrochage scolaire, intervenant SRE, coordonnateur de dispositifs relais ou d’Unité Localisée pour l’Inclusion Scolaire). Comme spécifié à l’article 7 du CCAP, cette exigence se présente sous la forme d’un volume horaire minimum et constitue une condition d’exécution du présent marché. Le volume horaire minimum est à réaliser pendant la durée totale du marché. Néanmoins, les candidats peuvent dépasser ce volume horaire s’ils le souhaitent. Le Cned se réserve le droit de procéder, après analyse des offres, à une négociation, dans le respect du principe d’égalité de traitement avec les candidats. Cependant, il pourra juger que, compte-tenu de la qualité des offres, la négociation n’est pas nécessaire. Il est donc de l’intérêt du candidat d’optimiser son offre initiale. L’opportunité de négocier sera évaluée lot par lot.
