Maksymalny rozmiar plików przesyłanych za pośrednictwem „Formularzy do komunikacji” wynosi 150 MB (wielkość ta dotyczy plików przesyłanych jako załączniki do jednego formularza). 8. Minimalne wymagania techniczne dotyczące sprzętu używanego w celu korzystania z usług Platformy e-Zamówienia oraz informacje dotyczące specyfikacji połączenia określa Regulamin Platformy e-Zamówienia. 9. W przypadku problemów technicznych i awarii związanych z funkcjonowaniem Platformy e-Zamówienia użytkownicy mogą skorzystać z infolinii Platformy e-Zamówienia dostępnej pod numerem telefonu 32/77-88-999 lub drogą elektroniczną poprzez formularz udostępniony na stronie internetowej https://ezamowienia.gov.pl w zakładce „Zgłoś problem”. 10. Zamawiający nie przewiduje sposobu komunikowania się z Wykonawcami w inny sposób niż przy użyciu środków komunikacji elektronicznej, wskazanych w SWZ. 11. Za pośrednictwem „Formularzy do komunikacji” odbywa się w szczególności przekazywanie wezwań i zawiadomień, zadawanie pytań i udzielanie odpowiedzi. Formularze do komunikacji umożliwiają również dołączenie załącznika do przesyłanej wiadomości (przycisk „dodaj załącznik”). 12. Sposób sporządzenia dokumentów elektronicznych, oświadczeń lub elektronicznych kopii dokumentów lub oświadczeń musi być zgody z wymaganiami określonymi w Rozporządzeniu dot. środków komunikacji elektronicznej. 1. Postępowanie o udzielenie zamówienia prowadzone jest w trybie przetargu nieograniczonego, zgodnie z art. 132 ustawy Pzp, o wartości przekraczającej progi unijne, o jakich mowa w art. 3 ustawy Pzp. 2. Odwrócona kolejność oceny ofert Zamawiający informuje, iż w przedmiotowym postępowaniu o udzielenie zamówienia publicznego zastosowana zostanie tzw. „odwrócona kolejność oceny ofert”, o której mowa w art. 139 ustawy Pzp. 3. Wykonawca nie podlega wykluczeniu w okolicznościach określonych w art. 108 ust. 1 pkt 1, 2 i 5 lub art. 109 ust. 1 pkt 2‒5 i 7‒10 ustawy Pzp, jeżeli udowodni Zamawiającemu, że spełnił łącznie przesłanki określone w art. 110 ust. 2 ustawy Pzp. 6. Zamawiający oceni, czy podjęte przez Wykonawcę czynności, o których mowa w art. 110 ust. 2 ustawy Pzp, są wystarczające do wykazania jego rzetelności, uwzględniając wagę i szczególne okoliczności czynu Wykonawcy, a jeżeli uzna, że nie są wystarczające, wykluczy Wykonawcę. 7. Zamawiający może wykluczyć Wykonawcę na każdym etapie postępowania, ofertę Wykonawcy wykluczonego uznaje się za odrzuconą. X. INFORMACJA O PRZEDMIOTOWYCH ŚRODKACH DOWODOWYCH 1. Zamawiający żąda złożenia następujących przedmiotowych środków dowodowych. L.p. Wymagany dokument 1. U. z 2024 r. poz. 1620) i zobowiązujemy się do dostarczenia na każde żądanie Zamawiającego kopii aktualnych dokumentów potwierdzających zgodność oferowanych wyrobów z odnoszącymi się do nich wymaganiami zasadniczymi (tj. deklaracja zgodności wytwórcy oraz certyfikat jednostki notyfikowanej - jeżeli dotyczy) Uwaga! jeżeli wyrób, który nie został sklasyfikowany jako wyrób medyczny zgodnie z dyrektywami europejskimi i ustawą o wyrobach medycznych z dnia 7 kwietnia 2022r. i nie jest objęty deklaracjami zgodności i nie podlega żadnemu wpisowi do rejestru, a więc nie posiada znaku CE to w tym przypadku Zamawiający wymaga załączenia oświadczenia, że oferowany w przedmiotowym postępowaniem produkt, ……… (należy go wymienić) nie jest objęty tym wymogiem i podać uzasadnienie tego faktu oraz podstawę prawną. Wykonawca zobowiązany jest dostarczyć kopie w/w dokumentów na każde żądanie zamawiającego - (Załącznik nr 1). 2. Jeżeli wykonawca nie złożył przedmiotowych środków dowodowych lub złożone przedmiotowe środki dowodowe są niekompletne, zamawiający wezwie do ich złożenia lub uzupełnienia w wyznaczonym terminie. 3. Zamawiający informuje, że pomimo przewidzenia wezwania, nie wezwie do złożenia lub uzupełnienia przedmiotowych środków dowodowych, jeżeli przedmiotowy środek dowodowy służy potwierdzeniu zgodności z cechami lub kryteriami określonymi w opisie kryteriów oceny ofert lub gdy mimo złożenia przedmiotowego środka dowodowego oferta podlega odrzuceniu albo zachodzą przesłanki unieważnienia postępowania. 4. Zamawiający może żądać od wykonawców wyjaśnień dotyczących treści przedmiotowych środków dowodowych. 5. Przedmiotowe środki dowodowe Wykonawcy składają wraz z ofertą. 6. Zamawiający akceptuje równoważne przedmiotowe środki dowodowe, jeżeli potwierdzają, że oferowane dostawy spełniają określone przez zamawiającego wymagania. XIII. INFORMACJA DLA WYKONAWCÓW WSPÓLNIE UBIEGAJĄCYCH SIĘ O UDZIELENIE ZAMÓWIENIA 1. Wykonawcy mogą wspólnie ubiegać się o udzielenie zamówienia. W takim przypadku Wykonawcy zobowiązani są do ustanowienia pełnomocnika do reprezentowania ich w postępowaniu o udzielenie zamówienia albo do reprezentowania w postępowaniu i zawarcia umowy w sprawie zamówienia publicznego. 2. Pełnomocnictwo należy dołączyć do oferty i powinno ono zawierać w szczególności wskazanie: 1) postępowania o udzielenie zamówienie publicznego, którego dotyczy; 2) wszystkich Wykonawców ubiegających się wspólnie o udzielenie zamówienia; 3) ustanowionego pełnomocnika oraz zakresu jego umocowania. 3. W przypadku wspólnego ubiegania się o zamówienie przez Wykonawców, dokument ”Jednolity europejski dokument zamówienia” oraz Oświadczenie Wykonawcy/wykonawcy wspólnie ubiegającego się o udzielenie zamówienia, o których mowa w Rozdziale IX pkt 1 ppkt 2 i 3 SWZ, składa każdy z Wykonawców wspólnie ubiegających się o zamówienie. Oświadczenia te potwierdzają brak podstaw wykluczenia oraz spełnianie warunków udziału w postępowaniu w zakresie, w jakim każdy z Wykonawców wykazuje spełnianie warunków udziału w postępowaniu.

Wykonawca nie jest zobowiązany do złożenia podmiotowych środków dowodowych, które Zamawiający posiada, jeżeli Wykonawca wskaże te środki oraz potwierdzi ich prawidłowość i aktualność. 6. Podmiotowe środki dowodowe oraz inne dokumenty lub oświadczenia Wykonawca składa, pod rygorem nieważności, w formie elektronicznej w postaci dokumentu elektronicznego podpisanego kwalifikowanym podpisem elektronicznym. 7.
