Justification for direct award: The contract can be provided only by a particular economic operator because of an absence of competition for technical reasons
Other justification: Das Verfahren wurde gemäß § 36 (1) 3. a Bundesvergabegesetz 2018 durchgeführt, da die Lieferung nur von einem bestimmten Unternehmen erbracht werden kann, weil aus technischen Gründen kein Wettbewerb vorhanden ist. Das bestehende System des Lieferanten Siemens soll vom derzeitigen Standort AKH an den zukünftigen Standort Klinik Penzing übersiedelt werden. Im Zuge der Übersiedlung ist ein entsprechendes Upgrade, das sowohl die bestehende Hardware als auch Software betrifft, vorzunehmen. Es war davon auszugehen, dass aus technischen Gründen neben dem Lieferanten Siemens Healthcare Diagnostics GmbH kein weiterer Bieter am Verfahren teilnehmen wird. Kein anderer Bieter kann die Leistung des Upgrades auf einem fremden bestehenden Produkt erbringen. Des Weiteren kann in Folge kein anderer Marktteilnehmer die entsprechenden Leistungen der Instandhaltung/Wartung (Ersatzteil-Verfügbarkeit, Software-Verfügbarkeit, Mitarbeiter-Schulung, etc.) für ein Fremdgerät erbringen. Ebenfalls war davon auszugehen, dass der potentielle Auftragnehmer Siemens Healthcare Diagnostics GmbH bei einer etwaigen Übersiedlung durch ein Fremd-Unternehmen von einem Upgrade bzw. einer Gewährleistung/Garantie/Instandhaltung Abstand nehmen würde. Auf Basis des genannten Sachverhalts wurde mit dem Auftragnehmer Siemens Healthcare Diagnostics GmbH ein Verhandlungsverfahren ohne vorherige Bekanntmachung mit nur einem Bieter durchgeführt. Ziel der gegenständlichen Beauftragung ist die Durchführung der folgenden Leistungen: • Übersiedlung vom derzeitigen Standort AKH an zukünftigen Standort Klinik Penzing, • Upgrade, • Inbetriebnahme und • Instandhaltung/Wartung des MRT Systems des Unternehmens Siemens Healthcare Diagnostics GmbH.
