Für jeden schuldhaften Verstoß gegen eine sich aus der Verpflichtungserklärung zu Tariftreue und Mindestentgelt ergebene Verpflichtung ist eine Vertragsstrafe in Höhe von einem Prozent der Nettoauftragssumme vom Auftragnehemer zu zahlen. Mit dem Angebot ist die Erklärung "EU-Sanktionspaket im Zusammenhang mit dem Angriffskrieg Russlands auf die Ukraine" einzureichen (s. Anlage 2).
