Description: VAV needs to enter into a new framework agreement for inspecting street foundations and facades. The contract will include set-up of vibration meters as well as site inspections of houses. Street foundations and facades shall be inspected for several projects, both before and after the execution of projects. Damage to the road foundation and property shall be documented in such assignments, resulting from blasting, pigging etc. In individual cases vibration meters will be set out in periods where work is being carried out. VAV shall enter into a framework agreement with one tenderer, but the contract is non-exclusive. The contracting authority has the right, but not an obligation, to procure services covered by the Framework Agreement, within the scope and length of the framework agreement. The upper financial framework for the procurement is NOK 100,000,000 excluding VAT. NOK 55,000,000 excluding VAT.

Description of selection criterion: The tenderer must have the financial capacity to carry out the assignment. Documentation requirements: • The company's annual accounts or extracts thereof if the publication of the annual accounts is required in the country where the tenderer is established. Description of selection criterion: • Experience is required from projects of an equivalent nature and degree of difficulty. By an equivalent nature and degree of difficulty, we mean surveys of street foundations in the city environment and reporting for vibration measurements. Documentation requirements: • An overview of relevant work carried out during the last 3 years. The overview shall state the time and place the work was performed, the nature of the work, the degree of difficulty as well as the contracting authority.

Description of selection criterion: The tenderer shall have good competence and good capacity, including, but not limited to: • Sufficient capacity to carry out assignments during the agreement period. Documentation requirements: • An account of the tenderer ́s average workforce.

Documentation requirements: • Copy of a valid certificate issued by independent bodies, for example ISO 9001 or equivalent. The quality assurance standard shall be based on relevant European standard series, which are certified by accredited bodies. The contracting authority will accept other equivalent certificates issued by bodies in other EEA countries. The contracting authority will also accept other documentation for equivalent quality assurance measures if the tenderer is unable to obtain such certificates by the deadline and this is not due to the tenderer himself. It is a prerequisite that the tenderer documents that these measures correspond to the requested quality assurance standards.

Description: Exceptions from the main rule in the Supply Regulations: In accordance with the Utilities Regulations § 7-9 second paragraph, the first period shall, as a main rule, be weighted with at least 30 percent in the award criteria. For this procurement, however, it is considered that it gives better climate and environmental effect to set concrete requirements in the requirement specifications, cf. § 7-9 third period second paragraph. Justification for exceptions from the main rule on weighting climate and environmental considerations: KOFA has stated that the contracting authority must substantiate why the exception is applicable in the concrete procurement, in accordance with the requirement for verifiability, cf. the KOFA case 2025/0819 section 30. The justification shall show that the exception gives an objectively better climate and environmental effect and that the contracting authority has a sufficient knowledge basis. It is sufficient that the effect is marginally better. The procurement concerns services for inspecting street foundations and facades. The concrete assessment of the climate and environmental effect is based on experience from previous procurements of the same performance, together with the minimum requirements based on, among other things, Oslo municipality ́s city council matter 1004/25. Transport of the resources that shall be used under the framework agreement is the most significant causal factor for climate and environmental footprint. In order to reduce the load associated with transport pollution, VAV sets the following minimum requirements for transport for all assignments: • Zero emission vehicles, i.e. 100% battery electrical or hydrogen powered vehicles, or; • biogas vehicles that at least fulfil Euro class 6/VI The contractual requirement applies for the last transport stretch ("cargo mile") of the service. This initiative gives a significant and documentable environmental gain and has greater effect than a general weighting of climate and environmental considerations for transport when awarding. Conclusion: Overall, it is clear that the above mentioned minimum requirements provide better climate and environmental effect, compared with weighting climate and environmental considerations as the award criterion. The above mentioned minimum requirements give a better climate and environmental benefit based on the nature and scope of the procurement. The requirements therefore fulfil the condition for exceptions from the main rule in accordance with the utilities regulations § 7-9 second section.
