Considerate le caratteristiche standardizzate della fornitura oggetto dell’appalto, l’aggiudicazione avverrà, distintamente per ciascun lotto, con il criterio del minor prezzo, ai sensi dell’art. 108, comma 3, del D.Lgs. 36/2023. Non sono ammesse offerte in aumento, parziali e/o condizionate. SMAT si riserva il diritto di: - non procedere all’aggiudicazione se nessuna offerta risulti conveniente o idonea in relazione all’oggetto del contratto; - annullare la gara o procedere all’aggiudicazione in presenza di una sola offerta valida; - sospendere, reindire o non aggiudicare la gara motivatamente; - non stipulare il contratto, anche qualora sia intervenuta in precedenza l’aggiudicazione, nel caso in cui ricorrano motivate ragioni. Il soggetto aggiudicatario sarà tenuto a presentare la documentazione di cui alla vigente normativa antimafia e ad accettare gli impegni ed obblighi imposti dal Codice Etico della SMAT. Si applica l’art. 124 del D.Lgs. 36/2023 nei casi ivi previsti.
