General information
Additional information: The procurement concerns the design and construction of approximately 22.1 km of new single-track railway forming Section 3 of Railway Corridor VIII – Eastern Section, from Kriva Palanka towards the border with the Republic of Bulgaria. The cross-border tunnel and its functional area are excluded from this Contract. The Works include review of the available reference design and investigations; preparation of the Detailed Design required for obtaining the construction permit; earthworks; permanent way; drainage; retaining structures; access roads; Kriva Palanka station; Zidilovo halt/station; 21 tunnels with an aggregate length of approximately 8.5 km; 51 bridges/viaducts with an aggregate length of approximately 5 km; environmental and social mitigation measures; and the civil and preparatory/interface works for signalling and telecommunications required by the Employer’s Requirements. The maximum design speed is 100 km/h. The Contract will be implemented under the FIDIC Conditions of Contract for Plant and Design-Build, First Edition 1999 (Yellow Book), as amended by the Particular Conditions. The procurement is an open, single-stage, two-envelope procedure conducted in accordance with the EIB Guide to Procurement. The procedure is paper-based. Participation is open to eligible legal entities from all countries, subject to the eligibility, exclusion, sanctions and conflict-of-interest requirements set out in the Procurement Document. Alternative proposals are not permitted. A Tender Security in the amount of EUR 10,000,000 in the form required by the Procurement Document shall accompany the Technical Proposal. Project-specific licences, permits, certificates and authorisations under the laws of the Republic of North Macedonia are not required to be held at Proposal submission, but Participants shall submit the prescribed undertaking concerning their timely application for and acquisition in accordance with the Procurement Document and the Contract. The Project is financed by the European Investment Bank, the European Bank for Reconstruction and Development and a Western Balkans Investment Framework grant.

Additional information: The stated 84-month contract duration comprises a Time for Completion of 1,825 days (60 months) followed by a Defects Notification Period of 730 days (24 months). The cross-border tunnel and its functional area do not form part of the Works under this Contract. The procurement is conducted as a single-stage, two-envelope procedure and the Contract will be based on the FIDIC Yellow Book 1999, as amended by the Particular Conditions.

Description of selection criterion: Participation is open to legal entities from all countries. Each Participant shall be duly constituted, incorporated or registered in accordance with the laws of its country of establishment and shall provide evidence of its legal status and registration as required by the Procurement Documents. In the case of a Joint Venture, Consortium or Association (JVCA), the applicable legal status and eligibility requirements shall be met by each member in accordance with the Procurement Documents. Participants shall submit Form ELI-1, the relevant charter or constitutional documents, registration/incorporation documents and, where applicable, the JVCA Agreement. Participants shall submit Form LIC-1 – Undertaking regarding Licences, Permits, Certificates and Authorisations, duly completed and signed. Participants are not required, at the deadline for submission of Proposals, to hold project-specific licences, permits, certificates or authorisations required under the laws of the Republic of North Macedonia for execution of the Works. For any such licence, permit, certificate or authorisation not held at Proposal submission, the Participant shall undertake in Form LIC-1, if awarded the Contract, to apply for and obtain it within the periods prescribed by the Procurement Documents and the Contract and, in all cases, before commencing the activity for which it is legally required.
