Description of the options: Opzione di proroga del contratto (art.120, comma 10, del D. Lgs. 36/2023 e s.m.i.): ViAmbiente si riserva la facoltà di prorogare il contratto per ulteriori 12 (dodici) mesi ai prezzi, patti e condizioni stabiliti nel contratto originario. L’esercizio di tale facoltà è comunicato all’appaltatore almeno 60 giorni prima della scadenza del contratto; in mancanza di tale comunicazione, il contratto terminerà allo scadere dei primi 24 mesi, senza che l’Appaltatore nulla possa pretendere. L’offerente pertanto è vincolato alla propria offerta per una durata contrattuale di 36 (trentasei) mesi, mentre la S.A., alla scadenza dei primi 24 mesi non è vincolata a proseguire con il contratto. Opzione di proroga tecnica: in casi eccezionali, il contratto in corso di esecuzione può essere prorogato per il tempo strettamente necessario alla conclusione della procedura di individuazione del nuovo contraente se si verificano le condizioni indicate all’articolo 120, comma 11, del D.Lgs. 36/2023 e s.m.i. In tal caso il contraente è tenuto all’esecuzione delle prestazioni oggetto del contratto agli stessi prezzi, patti e condizioni previsti nel contratto stesso. Variazione fino a concorrenza del quinto dell’importo del contratto (art.120, comma 9 del D.Lgs. 36/2023 e s.m.i.): qualora in corso di esecuzione si renda necessario un aumento o una diminuzione delle prestazioni fino alla concorrenza del quinto dell'importo del contratto, ViAmbiente può imporre all'appaltatore l'esecuzione alle condizioni originariamente previste.
