Si specifica che gli operatori devono essere in possesso dei seguenti requisiti di: - ordine generale (cfr. artt. 94 e 95 D. Lgs. 36/2023 e art. 5 del Capitolato d’oneri); - Idoneità professionale/Capacità economica e finanziaria/Capacità tecniche e professionali, come meglio precisato nel Capitolato d’Oneri Agli operatori sarà chiesto di produrre per ciascun Lotto: i) garanzia provvisoria ai sensi dell’art. 106 del D.Lgs. n. 36/2023, la cui quantificazione è indicata nella documentazione di gara; in caso di aggiudicazione: ii) garanzia definitiva in favore di Consip ai sensi dell’art. 117 del D. Lgs. n. 36/2023, come meglio chiarito nel Capitolato d’Oneri. Sono previste per ogni Lotto delle basi d’asta unitarie soggette a ribasso, non superabili, pena l’esclusione dalla gara, come meglio precisato nella documentazione di gara. La gara sarà aggiudicata sulla base del criterio dell’offerta economicamente più vantaggiosa sulla base del miglior rapporto qualità prezzo (90 pt tecnici/10 pt economici). È prevista: - la possibilità di estensione del 5% del massimale di ciascun lotto dell’Accordo Quadro (cfr. par. 3.4 del Capitolato d’Oneri e Schema di Accordo Quadro) ; - la facoltà delle Amministrazioni di ricorrere al sesto quinto sul singolo Contratto esecutivo, come meglio precisato nel Capitolato d’Oneri e nello Schema di Accordo Quadro. È consentito il subappalto con le modalità indicate nel Capitolato d’oneri. Considerato che allo stato, l’iniziativa non risulta connessa ad una specifica fonte di finanziamento, la documentazione di gara prevede, tuttavia, previsioni relative alla parità di genere e ai titolari effettivi, nonché richiama, in sede di Appalti Specifici (Lotti 1, 2 e 3) ai sensi dell’art. 9 del Regolamento (UE) 2021/1060, disposizioni in materia di DNSH, affinché le Amministrazioni possano utilizzare eventualmente fondi comunitari e/o nazionali. Per tutta la durata dell’Accordo Quadro e dei Contratti Esecutivi dei Lotti Applicativi 1, 2 e 3, ai sensi dell’art. 113 del Codice, sulla base di quanto previsto dal Regolamento ACN attualmente in vigore, è richiesto il possesso almeno del livello di qualificazione previsto per il trattamento dei dati ordinari, ossia il livello di qualificazione QC1 per i servizi cloud (cfr. art. 3Bis dello Schema di Accordo Quadro Lotti Applicativi 1, 2 e 3). La gara si svolgerà tramite Sistema informatico sul quale dovranno essere inserite le “OFFERTE”.
