Other information about renewals: De opdracht bevat een verlenging. De verlenging houdt in dat de contractuele voorwaarden ongewijzigd blijven. Deze verlenging wordt door de aanbestedende overheid meegedeeld via aangetekende zending, uiterlijk 3 maanden voor het verstrijken van de looptijd van de opdracht. Wanneer door Wonen in Limburg wordt vastgesteld dat de contractuele verplichtingen niet worden nagekomen, zal zij de dienstverlener hiervan per aangetekend schrijven in kennis stellen. Binnen de 30 kalenderdagen na dit schrijven dient door de dienstverlener schriftelijk een voorstel tot verbetering aan Wonen in Limburg te worden overgemaakt. Bij ontstentenis of bij vaststellen verdere inbreuken tegen de contractuele verplichtingen, zal Wonen in Limburg de dienstverlener ervan in kennis stellen dat de overeenkomst met onmiddellijke ingang wordt verbroken. In da geval is een forfaitaire schadevergoeding van toepassing gelijk aan 1/10 van de totale jaarlijks herziene basisvergoeding ongeacht eventuele andere, bijkomende schadevergoedingen.

Justification for the duration of the framework agreement: Aansluitend op de bovenvermelde looptijd kan de opdracht éénmaal worden verlengd met een periode van 4 jaar, op basis van artikel 57, tweede lid, van de Wet Overheidsopdrachten. Het is van belang dat gedurende de looptijd van dit contract de kwaliteit van alle installaties niet vermindert. Een korte looptijd van 4 jaar zal de dienstverlener er toe aanzetten om zo min mogelijk te investeren in nieuwe installaties en/of herstellingen gezien de periode waarbinnen hij kan rekenen op een terugverdieneffect van zijn eigen investeringen te kort is. Dit zal zich vertalen in minder gunstige prijsvoorwaarden voor Wonen in Limburg. Vandaar dat binnen deze opdracht afgeweken wordt van de gebruikelijk maximale uitvoeringstermijn van 4 jaar en gekozen wordt voor een langere looptijd van 8 jaar.
