Justification for the duration of the framework agreement: Aanbestedende dienst hanteert voor de raamovereenkomst een langere looptijd dan vier (4) jaar als bedoeld in artikel 2.140 lid 3 Aanbestedingswet. Aanbestedende dienst motiveert deze langere looptijd als volgt: • De opdracht ziet op busvervoer waarbij continuïteit, betrouwbaarheid, beschikbaarheid van vervoerscapaciteit en een zorgvuldige afstemming op de organisatie van Aanbestedende dienst essentieel zijn. Het vervoer moet gedurende de looptijd zonder onderbreking kunnen worden uitgevoerd. Een wisseling van Inschrijver vraagt om voorbereiding, implementatie, afstemming van routes, inzetplanning, communicatie, werkafspraken, klachtenafhandeling en borging van veiligheid en kwaliteit. Een te korte looptijd vergroot het risico op discontinuïteit en leidt tot een relatief hoge implementatie- en overdrachtslast ten opzichte van de aard en omvang van de opdracht. • Daarnaast is voor deze opdracht van belang dat Inschrijver tijdig voldoende geschikte vervoerscapaciteit, chauffeurs en materieel beschikbaar moet stellen. De beschikbaarheid van personeel en materieel staat in de markt onder druk. Een langere looptijd biedt Inschrijver meer zekerheid om capaciteit te organiseren, personeel te binden, materieel doelmatig in te zetten en processen structureel af te stemmen op de dienstverlening aan Aanbestedende dienst. Dit draagt bij aan een beheerste uitvoering van de opdracht en aan een stabiele prijs-kwaliteitverhouding gedurende de looptijd van de raamovereenkomst. Aanbestedende dienst acht een langere looptijd daarom noodzakelijk en proportioneel gelet op het voorwerp van de raamovereenkomst, de vereiste continuïteit van het vervoer, de benodigde implementatie- en afstemmingsinspanning en de marktomstandigheden rondom beschikbare vervoerscapaciteit. De langere looptijd gaat niet verder dan noodzakelijk is om deze doelstellingen te bereiken.
