Title: Dynamisches Beschaffungssystem Arzneimittel
Description: Einrichtung eines DBS zur Beschaffung von Arzneimitteln verschiedener Indikationsgruppen in verschiedenen Darreichungsformen. Das DBS erfolgt in zwei Phasen: 1. Einrichtung und Verwaltung eines Bieterpools Das DBS wird für die genannte Dauer und das genannte Leistungsspektrum eingerichtet. Das Verfahren wird ausschließlich elektronisch durchgeführt. Der öffentliche Auftraggeber bildet einen Bieterpool. Jeder Interessent kann zu jedem Zeitpunkt des DBS die Teilnahme am Verfahren aktivieren und einen Teilnahmeantrag einreichen. In den Bieterpool wird jeder Interessent aufgenommen, der die in der Bekanntmachung veröffentlichten Eignungskriterien erfüllt. Er wird damit zu einem potenziellen Bieter und kann bei den sich anschließenden Einzelvergaben ein Angebot einreichen. Der Bieterpool ist nicht größenbeschränkt. Jeder qualifizierte Teilnehmer wird in den Bieterpool aufgenommen. 2. Angebotsphase Die konkreten Beschaffungen erfolgen je nach Bedarf des öffentlichen Auftraggebers im Rahmen der Angebotsphase in Form von Einzelvergaben. Über den Zeitpunkt oder die Zahl der Einzelvergaben entscheidet der Auftraggeber. Es wird ausdrücklich darauf hingewiesen, dass keine Pflicht zur Durchführung von Einzelvergaben seitens des Auftraggebers besteht. Anlässlich der Einzelvergabe fordert der öffentliche Auftraggeber alle für das DBS zugelassene Teilnehmer des Bieterpools zur Abgabe eines Angebotes auf und teilt diesen die konkreten Bedingungen des Auftrags mit (z. B. Menge, Lieferzeit, Lieferort, Zuschlagskriterien etc.), sofern diese nicht bereits in der Bekanntmachung veröffentlicht wurden. Mit Abgabe eines Angebots erklärt der Bieter, dass keine Änderungen in den Eignungskriterien erfolgen. Die eingegangenen Angebote werden inhaltlich und anhand der bekannt gemachten Zuschlagskriterien geprüft. Der Bieter mit dem auf Grundlage der mitgeteilten Zuschlagskriterien zu ermittelnden wirtschaftlichsten Angebot erhält den Zuschlag. Die im Bieterpool des DBS zugelassenen Teilnehmer sind nicht verpflichtet, ein Angebot im Rahmen der Einzelvergaben abzugeben. Die Teilnehmer müssen sich stets über den aktuellen Stand des Vergabeverfahrens (der Einzelvergabe) informieren. Etwaige Fristverlängerungen, Bewerberfragen mit den entsprechenden Antworten oder sonstige Aktualisierungen und Änderungen müssen vom Teilnehmer selbstständig auf der e-Vergabe-Plattform des Bundes abgerufen werden. Etwaige Änderungen werden umgehend seitens des Auftraggebers bekannt gegeben.

(2) Antragsbefugt ist jedes Unternehmen, das ein Interesse an dem öffentlichen Auftrag oder der Konzession hat und eine Verletzung in seinen Rechten nach § 97 Absatz 6 GWB durch Nichtbeachtung von Vergabevorschriften geltend macht.
