Obiectul prezentului acord cadru consta în realizarea serviciilor de proiectare/asistenta tehnica din partea proiectantului si a lucrarilor de reparare/modernizare a drumurilor, prin desfacerea partilor degradate ale drumului (funda?ie sau îmbracaminte) ?i/sau executia unui nou sistem rutier, dupa caz. Se va aduce la cota sistemul rutier, capacele caminelor de canalizare (vizitare), gurile de scurgere, rasuflatorile de gaze, hidrantii, etc.

Riscul depunerii de documente/DUAE care nu pot fi vizualizate/deschise este in sarcina ofertantului, sub sanctiunea respingerii ofertei.
Atunci când doua sau mai multe oferte admisibile au preturi egale si sunt clasate pe acelasi loc, in primele 5 locuri pe fiecare lot ale clasam, în vederea departajarii lor pentru a fi atins nr max. de operatori ec cu care se doreste a fi încheiat AC, respective 5 operatori, entitatea contractanta va solicita respectivilor ofertanti reofertarea pretului, fara ca acest lucru sa afecteze pozitiile superioare din clasament ocupate de ceilalti ofertanti.
Solicitarile de clarificari ale potentialilor ofertanti se vor adresa in mod exclusiv in SEAP la Sect ”Intrebari” din cadrul procedurii de atribuire derulate prin mijloace electronice.
Raspunsurile la solicitarile de clarificari se vor posta in termen legal la rubrica de "Documentatii, clarificari si decizii" a anuntului de participare publicat pe site –ul www.e-licitatie.ro. Autoritatea contractanta nu va da curs solicitarilor adresate prin alta modalitate de comunicare. Comisia de evaluare va transmite solicitarile de clarificare privind ofertele depuse, in SEAP la Sect “Intrebari”. Op ec vor transmite raspunsurile la clarificari si eventualele documente solicitate pe parcursul evaluarii ofertelor prin intermediul SEAP (Sect “Intrebari”), integral in sect coresp respectivei solicitari, sub forma unuia sau a mai multor doc/fisiere distincte semnate cu semnatura electronica.
Oferta financiara care va fi criptata in SEAP si completata la nivelul formularului de oferta va fi cea rezultata din insumarea valorilor rezultate din inmultirea cantitatilor maxime aferente acordului cadru cu preturile unitare pe fiecare categorie de lucrari in parte .
Acordul cadru se va incheia cu maxim 5 operatori pe fiecare lot.
"Ofertantul elaboreaza oferta în conformitate cu prevederile documentatia de atribuire si INDICA, MOTIVAT, ÎN CUPRINSUL ACESTEIA CARE INFORMATII DIN PROPUNEREA TEHNICA SI/SAU DIN PROPUNEREA FINANCIARA SUNT CONFIDENTIALE, clasificate sau sunt protejate de un drept de proprietate intelectuala, in baza legislatiei aplicabile.”
Operatorii ec pot complete DUAE prin utilizarea formularului editabil anexat prezentei doc.
Atribuirea contractelor subsecv (CS) se va face fara reluarea competi?iei. Pentru atribuirea fiecarui (CS), Promitentul Achizitor (PA) transmite o invita?ie de semnare a unui asemenea contract la prezentul Acord-Cadru Promitentului Executant (PE), care este chemat sa dea curs invitatiei.
- PE va fi tinut sa transmita PA prop fin pentru cantitatile care fac obiectul contractului subsecvent si termenul limita de executare a acestuia. Prop fin pentru CS se va raporta la preturile unitare din Anexa prop fin la Acordul-Cadru.
- Invitatia se va transmite doar PE aflat pe locul intai la data semnarii prezentului Acord-cadru.
- Prin exceptie, aceeasi invitatie se poate transmite PE aflat pe urmat loc in clasam final intocmit conform rap procedurii, din cadrul aceluiasi Lot, in urmatoarele situatii de exceptie:
- PE declara ca nu mai are capac de a presta/executa cantit de servicii/lucrari ce urmeaza a forma obiectul CS;
- PE de pe locul întâi nu onoreaza in termenul maximal invitatia initiala adresata acestuia ori refuza semnarea CS ori refuza sa mai preia ordine de lucru in cadrul unui CS in vigoare;
- PE de pe locul intai mentioneaza in raspunsul la invitatie alte preturi unitare decat cele prevazute in propunerea financiara anexa la Acordul-Cadru sau un termen de executare a obiectului CS mai mare decat termenul indicat in oferta sa tehnica/ invitatie;
- PE de pe locul intai nu depune, fara o justificare agreata cu PA in original, in termen de 5 ( cinci) zile lucratoare de la data semnarii CS garantia de buna executie aferenta CS
