Award criterion number: 70
Criterion:
Type: Quality
Description: Quality
Category of award weight criterion: Weight (percentage, exact)
Award criterion number: 30
Criterion:
Type: Quality
Description: According to the main rule in the Public Procurement Act (LOA), § 5 b second section, climate and environmental considerations shall be weighted with a minimum of 30 percent when using the award criteria. The contracting authority can, however, replace the award criteria with climate and environmental requirements in the requirement specifications if this gives a better climate and environmental effect, cf. the Public Procurement Regulations § 5 b second paragraph of the third period. The procurement is for a framework agreement for equipment for gym halls, sports halls and sports facilities, with the accompanying assembly, control and service. According to the contracting authority ́s assessment, the climate footprint of the procurement is particularly connected to the production of the equipment and to transport and delivery to a large number of delivery addresses. The contracting authority has, thus, requirement 4.3 in the requirement specifications set as the minimum requirement that all transport, delivery and production connected to goods and services under the framework agreement shall be net emission free. The requirement applies to the entire supplier chain. Climate gas emissions that occur in production, transport or delivery, the supplier shall compensate with CO2 quotas. The framework agreement will be completely net emission free. This applies regardless of which tenderer is awarded the contract and for all goods and all call-offs during the entire contract period. An award criteria does not provide such security, because tenders with emissions can still win the competition, for example through a lower price. A minimum requirement must, however, be met by everyone, and tenders that do not fulfil the requirement will be rejected. By demanding that the chosen supplier take the cost of greenhouse gas emissions, tenderers also have a stronger incentive to reduce emissions, and to offer products with a low greenhouse gas emissions than if one had evaluated a low or lower emissions. The framework agreement will continue for four years, including options and thus applies until the climate target for 2030 shall be reached, where greenhouse gas emissions shall be reduced by at least 50 percent. By making requirements for net emission free, the framework agreement actively contributes to the climate target being met. A minimum requirement for net emission free production, transport and delivery is to ensure that the procurement turns green in it's entirety. The contracting authority considers, on this basis, that the minimum requirement gives a better climate and environmental effect than an award criterion. Climate and environmental considerations are therefore not weighted in the award criteria, cf. the Public Procurement Regulations § 5 b second section.
