Other justification: The existence of an exclusivity is based on the following elements: 1. Italian legislation on the organisation of the Games Pursuant to Article 2 of Law Decree No. 16 of 11 March 2020, converted by Law No. 31 of 8 May 2020, and as confirmed by Article 34(3) of Law Decree No. 115 of 9 August 2022, the Fondazione Milano Cortina 2026, is designated as the Organising Committee of the Games and entrusted with all activities relating to the management, organisation, promotion and communication of the Olympic and Paralympic Games. 2. The Host City Contract (HCC) The HCC, concluded between the International Olympic Committee (IOC), the Host Cities of Milan and Cortina d’Ampezzo, and the Italian National Olympic Committee (CONI), provides that the Fondazione Milano Cortina 2026 is the entity established to manage all operational aspects of the planning, organisation, financing and staging of the Games. Under this contractual framework, the IOC remains the worldwide owner of the event and of the related intellectual property rights, while the Fondazione benefits from a licence granting exclusive commercial exploitation rights on the Italian territory, in particular in the fields of promotion, communication, sponsorship, visibility and ticketing. 3. These exclusive rights are also reflected in Articles 3.1 and 3.2 of its By-Laws which provides for the Fondazione to carry out a series of purely private activities: management, organisation, promotion and communication of sporting and institutional events relating to the stage of the Games, including, among other things, the identification of the dates and places of individual sporting events, the care and management of the preparatory and closing events of the Games, the preparation of the organisational and management structures aimed at welcoming the Olympic and Paralympic delegations and their athletes, members of the organisational staff and members of the related teams, the organisation and management of individual competitions and sporting events, from both a technical-sporting and managerial and promotional point of view, the sale of tickets and all rights to exploit Olympic sporting events in general, as well as any other activity directly or indirectly connected with the organisation of the Games. It follows that the Fondazione Milano Cortina 2026 is the only economic operator in a position to authorise, design and provide communication and visibility services in connection with the Milano–Cortina 2026 Olympic and Paralympic Games, including, in particular, institutional visibility and promotional actions linked to the event. For all these reasons, according to art. 167(5)(f) FR and art. 11.1(b)(iii) of Annex I to FR , the contract may be concluded without prior publication of a contract notice and without competition, as the services may be supplied only by a specific economic operator for reasons linked to the existence of exclusive rights.
