Die ursprüngliche Laufzeit sollte am 01.11.2020 beginnen und am 30.10.2024 enden.
Bei der Konzeption des ursprünglichen Vergabeverfahrens wurde davon ausgegangen, dass spätestens bis Ende 2023 die Spezifikationen für elektronische Gesundheitskarten der Generation G3 vorliegen. Diese Konzeption beruhte auf den zeitlichen Planungen der gematik, die als Nationale Agentur für Digitale Medizin für die Definition und Durchsetzung der verbindlichen Standards für Dienste, Komponenten und Anwendungen in der Telematikinfrastruktur zuständig ist. Im Laufe des Jahres 2024 wurde jedoch bekannt, dass elektronische Gesundheitskarten der Generation G3 erst ab 01.01.2026 ausgabefähig sein werden. Vor diesem Hintergrund wurde es notwendig, auch im Zeitraum vom 01.11.2024 bis 31.12.2025 weiter elektronische Gesundheitskarten der Generation G2 an die Versicherten auszugeben. Daher wurde der Vertrag gemäß § 132 Abs. 2 S. 1 Nr. 3, S. 2 GWB bis 31.12.2025 verlängert und die Verlängerung auch im EU-Amtsblatt durch die Auftraggeberinnen jeweils bekannt gemacht.
Im Laufe des Jahres 2025 wurde jedoch bekannt, dass elektronische Gesundheitskarten der Generation G3 auch zum 01.01.2026 nicht ausgabefähig sein werden. Vor diesem Hintergrund wurde es erneut notwendig, auch im Zeitraum vom 01.01.2026 bis 31.12.2026 weiter elektronische Gesundheitskarten der Generation G2 an die Versicherten auszugeben.
Die vorgenommene Änderung des bestehenden Auftrags ist daher nach § 132 Abs. 2 S. 1 Nr. 3, S. 2 GWB zulässig. Die Änderung ist aufgrund von Umständen erforderlich geworden, die im Rahmen der hiesigen Sorgfaltspflicht nicht vorhergesehen werden konnten. Die Änderung führt auch weder zu einer Veränderung des Gesamtcharakters des ursprünglichen Auftrags noch zu einer Überschreitung der Grenze von 50 Prozent des Wertes des ursprünglichen
