Title: Achiziția de Capacități modulare de producere de energie termică (tip container) pentru rețeaua de termoficare a Municipiului București.
Description: Achiziția presupune încheierea unui acord-cadru cu obiectul descris în detaliu în caietul de sarcini nr. 14019/03.11.2023 Revizia 1, respectiv “Capacități modulare de producere de energie termică (tip container) pentru rețeaua de termoficare a Municipiului București“, împărtită în 3 loturi, după cum urmează: - LOT 1- Capacități modulare de producere de energie termică (tip container) pentru Puncte Termice SDS1 + SDS 3 Vitan; - LOT 2 – Capacități modulare de producere de energie termică (tip container) pentru Puncte Termice SDS 2 + SDS 4; - LOT 3 – Capacități modulare de producere de energie termică (tip container) pentru Puncte Termice SDS 5 + SDS 6 Drumul Taberei + SDS 6 Militari. Obiectul Caietului de sarcini reprezintă enunțarea cerințelor minime ale autorității contractante. Termenul limită până la care operatorii economici pot transmite în SEAP solicitări de clarificări este cel târziu în a 18 -a zi înainte de termenul stabilit pentru depunerea ofertelor. Autoritatea Contractantă va răspunde în mod clar și complet tuturor solicitărilor de clarificări – în a 11-a zi înainte de termenul limită stabilit prin Anunțul de participare pentru depunerea ofertelor. Se va raspunde doar la solicitările de clarificări adresate de operatorii economici în termenul limită enunțat anterior. Achiziționarea produselor se va realiza, printr-un acord-cadru. Durata acordului-cadru va fi de 12 luni de la data semnării pentru fiecare LOT, și va fi încheiat cu maxim 2 operatori economici. Părțile au dreptul, pe durata Acordului-Cadru/ a Contractului Subsecvent, de a conveni modificarea și/sau de a completa clauzele acestora, fără organizarea unei noi proceduri de atribuire, fără a afecta caracterul general al Contractului Subsecvent, în limitele Legii și în aplicarea prevederilor prevăzute de art. 221-222 din Legea nr. 98/2016, coroborate cu prevederile din Contractul Subsecvent sau al Acordului-cadru. Motivul principal pentru care se propune încheierea acordului-cadru cu doi operatori economici este de a minimiza riscul neexecutării acordului-cadru, în situația în care operatorul economic căruia Autoritatea contractantă îi transmite o solicitare pentru încheierea unui contract subsecvent nu are capacitatea de a răspunde acestei solicitări, deoarece cantitatea care face obiectul contractului depășește cantitatea estimată sau intervine propria sa culpă. În acest sens, Autoritatea contractantă are posibilitatea de a se adresa promitentului-contractant clasat pe locul 2. Astfel, decizia de a atribui contractele subsecvente fără reluarea competiției este motivată de necesitatea obținerii produselor într-un timp cât mai scurt de la solicitarea autorității contractante.
