Other justification: Bij de raamovereenkomst met de broker voor Inhuur gespecialiseerd personeel gericht op bedrijfsvoeringsfuncties heeft zich een situatie voorgedaan die heeft geleid tot ontbinding van die overeenkomst. Aanbestedende dienst ziet zich daardoor genoodzaakt een beroep te doen op de onderhandelingsprocedure zonder aankondiging wegens dwingende spoed (artikel 2.32 lid 1 sub c Aanbestedingswet 2012). Dit motiveert aanbestedende dienst als volgt: - de provincie heeft daadwerkelijk inzet op een bedrijfsvoeringsfunctie nodig; - doordat de overeenkomst reeds ontbonden is, is er geen tijd om een Europese aanbestedingsprocedure met inachtneming van de wettelijke minimumtermijnen te doorlopen; - er is ook geen tijd om een Europese aanbestedingsprocedure met verkorte termijnen te doorlopen als bedoeld in artikel 2.74 Aanbestedingswet 2012 te doorlopen en - de ontbinding met de huidige opdrachtnemer niet was te voorzien, noch dat de situatie van dwingende spoed aan de provincie is te wijten. Voordat de situatie die tot de ontbinding leidde zich voordeed, was aanbestedende dienst reeds gestart met een Europese aanbestedingsprocedure. De bijbehorende overeenkomst zal naar verwachting halverwege 2026 ingaan.
