Other justification: Perkančioji organizacija vykdo pirkimą, kurio tikslas – įsigyti Ukrainos valstybinės nepaprastų situacijų tarnybos ir Ukrainos valstybinės specialiosios transporto tarnybos (toliau – Naudos gavėjai) turimų išminavimo mašinų MV­10 atsargines dalis. Atsižvelgiant į pirkimo objekto specifiką ir gamintojo pateiktus argumentus, pirkimą nuspręsta vykdyti neskelbiamų derybų būdu su vieninteliu tiekėju –DOK­ING Ltd., vadovaujantis Viešųjų pirkimų įstatymo 71 straipsnio 1 dalies 2 punkto b) ir c) papunkčiais, kurie leidžia vykdyti pirkimą neskelbiamų derybų būdu, kai konkurencijos nėra dėl techninių priežasčių arba kai prekės gali būti tiekiamos tik dėl išimtinių teisių, įskaitant intelektinės nuosavybės teises. DOK­ING Ltd. yra originalus MV­10 projektavimo ir serijinės gamybos vykdytojas, turintis visas projektavimo, gamybos ir kokybės kontrolės technologijas, reikalingas originalių atsarginių dalių gamybai. Gamintojas patvirtino, kad nėra kitų tiekėjų, galinčių pagaminti dalis pagal originalią specifikaciją ir užtikrinti jų techninį suderinamumą bei saugų naudojimą. Be to, DOK­ING Ltd. turi galiojančias intelektinės nuosavybės teises į MV­10 modelio konstrukcinius sprendimus ir technologiją, todėl tik šis gamintojas vienintelis gali tiekti originalias atsargines dalis. Dėl minėtų techninių ir teisinių priežasčių konkurencija objektyviai neegzistuoja, o pirkimas iš kito tiekėjo būtų techniškai nepagrįstas ir pažeistų gamintojo teises. Todėl neskelbiamos derybos su vieninteliu tiekėju yra teisėtas ir pagrįstas pirkimo būdas, užtikrinantis įrangos suderinamumą, saugumą ir patikimą eksploatavimą.
