Información sobre los plazos de revisión: Ein Nachprüfungsantrag ist nur zulässig, wenn • der Antragsteller von ihm erkannte Verstöße gegen Vergabevorschriften im Vergabeverfahren gegenüber dem Auftraggeber innerhalb von 10 Kalendertagen nach Kenntnis gerügt hat, • der Antragsteller Verstöße gegen Vergabevorschriften, die aufgrund der Bekanntmachung erkennbar sind, spätestens bis zum Ablauf der in der Bekanntmachung genannten Frist zur Bewerbung gegenüber dem Auftraggeber gerügt hat, • der Antragsteller Verstöße, die in den Vergabeunterlagen erkennbar sind, spätestens bis zum Ablauf der Angebotsfrist gegenüber dem Auftraggeber gerügt hat, • nicht mehr als 15 Kalendertage nach Eingang der Mitteilung des Auftraggebers, einer Rüge nicht abhelfen zu wollen, vergangen sind. Die Zulässigkeit eines Nachprüfungsantrags setzt ferner voraus, dass die geltend gemachten Vergabeverstöße 10 Kalendertage nach Kenntnis gerügt wurden (§ 160 Abs. 3 Satz 1 Nr. 1 GWB). Verstöße gegen Vergabevorschriften, die aufgrund der Bekanntmachung erkennbar sind, müssen spätestens bis zum Ablauf der in der Bekanntmachung benannten Frist zur Bewerbung oder zur Angebotsabgabe gegenüber dem Auftraggeber gerügt werden (§ 160 Abs. 3 Satz 1 Nr. 2 GWB). Verstöße gegen Vergabevorschriften, die erst in den Vergabeunterlagen erkennbar sind, müssen spätestens bis zum Ablauf der Frist zur Bewerbung oder zur Angebotsabgabe gegenüber dem Auftraggeber gerügt werden (§ 160 Abs. 3 Satz 1 Nr. 3 GWB). An application for review is also inadmissible if the contract has been awarded before the awarding chamber has informed the contracting authority of the application for review (sections 168 (2) sentence 1, 169 (1) GWB). The contract may be awarded 15 calendar days after the bidder information has been sent in accordance with Section 134 (1) GWB. If the information is sent electronically or by fax, the deadline is reduced to 10 calendar days (Section 134 (2) GWB). The period begins on the day after the information is sent by the contracting authority; the day of receipt by the bidder and candidate concerned is irrelevant. The admissibility of an application for review also requires that the alleged breaches of procurement regulations have been notified within 10 calendar days of becoming known (Section 160 (3) sentence 1 no. 1 GWB). Violations of procurement regulations that are recognisable on the basis of the contract notice must be notified to the contracting authority no later than the expiry of the deadline for application or submission of tenders specified in the contract notice (Section 160 (3) sentence 1 no. 2 GWB). Violations of procurement regulations that are only recognisable in the tender documents must be reported to the contracting authority by the expiry of the deadline for submitting applications or tenders at the latest (Section 160 (3) sentence 1 no. 3 GWB).
