Förklaring:
The company NEC, National Electrostatic Corporation, Wisconsin, USA, tax ID number 39-1051063, who manufactures the accelerator system, has now stopped supporting the original control system. There are no alternative suppliers of the needed renewing of the control system, due to its very specific and unique construction which only NEC has knowledge about. Also, other companies cannot deliver parts which would fit with the existing accelerator system. This means that a negotiated procedure without prior announcement in accordance with the Swedish Public Procurement Act (2016:1145) chapter 6 § 14 section 2 is applicable: for technical reasons there is no competence on the market for this renewal of the control system. Also, chapter 6 § 14 section 3 applies, since the subject-matter of procurement is protected by exclusive rights, and therefore can only be supplied by the mentioned certain supplier.
Swedish Public Procurement Act (2016:1145) chapter 6 § 14 section 2 corresponds to the EU directive 2014/24 article 32 section 2.b.ii technical reasons.
Swedish Public Procurement Act (2016:1145) chapter 6 § 14 section 3 corresponds to the EU directive 2014/24 article 32 section 2.b.iii exclusive rights.
