1. Exclusion conditions:
in accordance with Articles 106 and 107 of the Financial Regulation applicable to the budget of the Union, candidates shall be excluded from participating in and being awarded the contract if:
(a) they are bankrupt or being wound up, are having their affairs administered by the courts, have entered into an arrangement with creditors, have suspended business activities, are the subject of proceedings concerning those matters, or are in any analogous situation arising from a similar procedure provided for in national legislation or regulations;
(b) they or persons having powers of representation, decision making or control over them have been convicted of an offence concerning their professional conduct by a judgment of a competent authority of a Member State which has the force of 'res judicata';
(c) they have been guilty of grave professional misconduct proven by any means which the contracting authorities can justify, including by decisions of the EIB or international organisations;
(d) they are not in compliance with their obligations relating to the payment of social security contributions or the payment of taxes in accordance with the legal provisions of the country in which they are established or with those of the country of the contracting authority or those of the country where the contract is to be performed;
(e) they or persons having powers of representation, decision making or control over them have been the subject of a judgment which has the force of res judicata for fraud, corruption, involvement in a criminal organisation, money laundering or any other illegal activity, where such illegal activity is detrimental to the Union's financial interests;
(f) they are currently subject to an administrative penalty (exclusion from contracts financed from the budget of the Union for a maximum period of 10 years):
— either because they have been guilty, during another procurement procedure, of misrepresenting the information required by the contracting authority as a condition of participation in the contract in question or fail to supply that information,
— or because they have been declared to be in serious breach of contract following another contract procedure.
In addition, this contract shall not be awarded to candidates who, during the procurement procedure for this contract:
(g) are subject to a conflict of interests;
(h) are guilty of misrepresenting the information required by the contracting authority as a condition of participation in the contract or fail to supply that information.

2. At the request to participate stage:
candidates must provide:
(a) a solemn declaration, duly signed and dated by a legal representative of the company, stating that they are not in any of the situations listed in Articles 106 and 107 of the Financial Regulation.
The declaration must be accompanied by documents proving the signatory's powers of signature.
A standard solemn declaration form is available on the Consilium Tendering website (https://tendering.consilium.europa.eu/forms.aspx). For candidates submitting their request to participate electronically, the solemn declaration will be automatically added during the electronic submission;
(b) a document proving their authorisation to produce the object covered by the contract in accordance with national law of the Member State of residence. Accepted documents are, for example: a copy of the certificate of enrolment on the professional or trade register.
