— lot 1: 20 Schindler lifts in the Lex Building, 155 rue de la Loi, 1048 Brussels,

— lot 2: 5 Kone lifts in the Council of the EU's 'Crèche' building, 100 avenue de la Brabançonne, 1030 Brussels.

This servicing includes preventive maintenance, call-outs and repairs.

For lot 1 only: the contractor's technicians shall also be on duty during Council sessions and at special events in order to free trapped people within the stipulated time limits.

For reasons of service life and security of persons, a lift needs systematic and professional preventive maintenance.

Owing to their complex nature, the lifts must be serviced by contractors specialised in the field.

This servicing includes preventive maintenance, call-outs and repairs.

For lot 1 only: the contractor's technicians shall also be on duty during Council sessions and at special events in order to free trapped people within the stipulated time limits.

Section III: Legal, economic, financial and technical information

III.1)Conditions for participation
III.1.1)Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers
List and brief description of conditions:

1. Exclusion conditions:

in accordance with Articles 106 and 107 of the Financial Regulation applicable to the budget of the Union, candidates shall be excluded from participating in and being awarded the contract if:

(a) they are bankrupt or being wound up, are having their affairs administered by the courts, have entered into an arrangement with creditors, have suspended business activities, are the subject of proceedings concerning those matters, or are in any analogous situation arising from a similar procedure provided for in national legislation or regulations;

(b) they or persons having powers of representation, decision making or control over them have been convicted of an offence concerning their professional conduct by a judgment of a competent authority of a Member State which has the force of 'res judicata';

(c) they have been guilty of grave professional misconduct proven by any means which the contracting authorities can justify, including by decisions of the EIB or international organisations;

(d) they are not in compliance with their obligations relating to the payment of social security contributions or the payment of taxes in accordance with the legal provisions of the country in which they are established or with those of the country of the contracting authority or those of the country where the contract is to be performed;

(e) they or persons having powers of representation, decision making or control over them have been the subject of a judgment which has the force of res judicata for fraud, corruption, involvement in a criminal organisation, money laundering or any other illegal activity, where such illegal activity is detrimental to the Union's financial interests;

(f) they are currently subject to an administrative penalty (exclusion from contracts financed from the budget of the Union for a maximum period of 10 years):

— either because they have been guilty, during another procurement procedure, of misrepresenting the information required by the contracting authority as a condition of participation in the contract in question or fail to supply that information,

— or because they have been declared to be in serious breach of contract following another contract procedure.

In addition, this contract shall not be awarded to candidates who, during the procurement procedure for this contract:

(g) are subject to a conflict of interests;

(h) are guilty of misrepresenting the information required by the contracting authority as a condition of participation in the contract or fail to supply that information.

2. At the request to participate stage:

candidates must provide:

(a) a solemn declaration, duly signed and dated by a legal representative of the company, stating that they are not in any of the situations listed in Articles 106 and 107 of the Financial Regulation.

The declaration must be accompanied by documents proving the signatory's powers of signature.

A standard solemn declaration form is available on the Consilium Tendering website (https://tendering.consilium.europa.eu/forms.aspx). For candidates submitting their request to participate electronically, the solemn declaration will be automatically added during the electronic submission;

(b) a document proving their authorisation to produce the object covered by the contract in accordance with national law of the Member State of residence. Accepted documents are, for example: a copy of the certificate of enrolment on the professional or trade register.

III.1.2)Economic and financial standing
List and brief description of selection criteria:

1. certificate of enrolment on the professional or trade register or a statement under oath or a certificate in accordance with conditions laid down in the Member State of residence;

2. copy of the balance sheets and operating accounts, or other supporting documents, for the past 3 years;

3. statement as to overall turnover and turnover for the works and services referred to in the contract, realised over the past 3 financial years.

Minimum level(s) of standards possibly required:

Lot 1: turnover for lift maintenance services must have been at least 400 000 EUR per year during the past 3 financial years.

Lot 2: turnover for lift maintenance services must have been at least 30 000 EUR per year during the past 3 financial years.

III.1.3)Technical and professional ability
List and brief description of selection criteria:

1. documents attesting to professional and technical capacity and to at least 3 years' professional experience of the type of services required;

2. list of the principal services, of an equivalent nature to those required, provided over the past 3 years. The tenderer is to specify, for each contract mentioned, the values, dates and names and particulars of the public or private recipients involved. More specifically, for the main contracts performed, the tenderer must provide detailed information on the nature and quantity of the services provided;

3. statement as to the tenderer's average annual manpower and the number of managerial staff during the past 3 years;

4. statement showing the candidate's ability to maintain the equipment involved in the contract (Schindler and/or Kone lifts), certifying knowledge of the technologies necessary to provide the services required;

5. description of the candidate's facilities in order to ensure his ability to intervene within the emergency time limits stipulated in the contract (up to 30 minutes where people are trapped).

Lot 1: a list of 10 all-purpose maintenance contracts, including at least 20 lifts per contract.

Lot 2: a list of 10 all-purpose maintenance contracts, including at least 5 lifts per contract.

3. The average manpower must have been at least 50 technicians assigned to maintenance during each of the past 3 years.

Candidates must provide evidence of their capacity to procure spare parts for Schindler (lot 1) and/or Kone (lot 2) lifts.

Lot 1: the declaration must certify knowledge of DCS Miconic X technology.

Lot 2: the declaration must certify knowledge of LCE-V3F and MX motor technology.

5. The candidate must have a coordination centre that can be contacted 24/7.
