Procurement of high-voltage devices for Kremenchuk HPP and Kakhovka HPP

TThe Scope of the Contract shall include the supply of high-voltage devices (HVD) for:

1. Kremenchuk HPP –1 pcs 3- phase 330 kV disconnector, and mandatory spare parts;

2. Kakhovka HPP – 51 pcs vertical insulating bushing with built-in current transformers;

3. Kakhovka HPP – 537 pcs support insulator.

Deadline for supply of goods: June 2023

The scope of work shall include all expenses, including cost of labour, materials and equipment required for design, manufacturing, factory acceptance tests, transportation, delivery on site, visual inspection before unloading and related services for supervision of works on site and supervision of tests on site, as well as attending to all necessary meetings with the Purchaser.

II.2.4)Description of the procurement:

The applicable version of the GPP (Guide to Procurement for Project financed by the EIB) is: the Guide to Procurement as of September 2018.

The applicable version of the Prohibited Conducts of the Guide to Procurement of EIB is dated September, 2018.

Eligible Participants:

Firms and individuals from all countries are permitted to offer goods, works and services for Bank-financed projects, regardless of whether the country is a member of the Bank, unless, as a matter of law or official regulation, the Client’s country prohibits commercial relations with the firm’s country.

Tender Security:

The Tender Security amount and currency shall be: 55.000,00 € (fifty five thousand Euros)

Format and Signing of Tender:

In addition to the Original Tender Document in English, the Participant shall provide three (3) paper copies (two in English and one in Ukrainian) + two (2) soft copies (one in English and one in Ukrainian) including Price Schedules in MS Excel format, technical descriptions in MS Word format, Technical Data Forms in MS Excel format and any brochures, drawings and diagrams in Acrobat PDF-format.

The soft copy of the Tender Documents must be submitted in separate sealed envelope, duly marked as “SOFT COPY”. This envelop shall then be enclosed with the Original and the three hard copies in one single envelope.

In case of any discrepancy between the hard and soft copies, the hard copy version shall prevail.

Each inner envelope marked “ORIGINAL” or “COPY No. xx” shall contain the followings:

the Letter of Tender and the Tender Submission Form shall be directly inside the first-inner envelope;

the additional second-inner envelope containing all Tender documents to be submitted simultaneously (for instance, supporting documentation as to the Participant’s eligibility and its power of attorney). This second-inner envelope shall bear an additional identification mark “General Documentation”.

Section III: Legal, economic, financial and technical information

III.1)Conditions for participation
III.1.1)Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers
List and brief description of conditions:

(i) No conflicts of interests;

(ii) Not having been declared ineligible by the Bank;

(iii) No affiliate of the Borrower/the Grant Recipient, or the Client, or of a procurement agent engaged by the Client, shall be eligible to participate in a tender in any capacity whatsoever unless it can be demonstrated that there is not a significant degree of common ownership, influence or control amongst the Borrower/the Grant Recipient, the Client or the Client’s agent and affiliate.

(iv) Not having been excluded based on a conviction of an intentional crime, the national law prohibition UN SC decisions.

III.1.2)Economic and financial standing
List and brief description of selection criteria:

The Participant or any JVCA partner shall show its capacity to meet financial obligations, prove its financial situation and profit margin, demonstrate its current profitability and in a long-term perspective. For this purpose the Participant or a partner of JVCA shall provide audited balance sheets for the last 3 (three) years, or, if such balance sheet is not provided according to the legislation of the Tenderer’s country, other annual financial statements for the last 3 (three) years, confirmed by auditor’s reports or tax declarations/documents stating that tax authorities received statements.

Minimum average annual turnover shall be EURO five millions five hundred thousands (EUR 5,500,000.00).

Average annual turnover of the Participant or any JVCA partner shall be calculated as total turnover from operating activities within the last three (3) years, divided into a number of years.

The Participant or any JVCA partner must demonstrate that it has liquid assets or access to them, real assets unencumbered by the third parties rights, lines of credit and other financial means (independent of any contractual advance payments), sufficient to meet the cash flow requirements estimated at the following amounts for the implementation of relevant contract, taking into account the Applicant commitments under other contracts: two millions Euros (EUR 2,000,000.00).

The Participant or any JVCA partner must demonstrate that it has sufficient sources of funding to meet the cash flow requirements for currently active works and in relation to future contractual commitments.

The Participant shall provide information on its current commitments and pending awards*, which will be implemented in parallel with the Contract under this Tender.

The amount of annual** commitments under mentioned contracts shall not exceed the turnover of the Participant for the last year by more than one-and-a-half (1.5) times.

If the amount of annual commitments exceeds it by more than one and a half (1.5) times, the Tender will be rejected.

* current and expected commitments under all contracts awarded to the Participant under which the Letter of Intent or Letter of Acceptance was received.

III.1.3)Technical and professional ability
List and brief description of selection criteria:

(i) Experience as a supplier, in the execution of at least five (5) contracts for the supply of similar high voltage Equipment, each contract with a value at least EUR 250.000 equivalent, that have been successfully and substantially completed within the last 5 years and that are similar to the proposed contract.

The similarity shall be based on the nature of the goods, but may take into account other key characteristics of the Contract, as described in Section VI, Requirements

(ii) Specific expertise in the following key activity for at least fifteen (15) similar high voltage Equipment:

• On-site installation supervision;

• On-site tests and commissioning

III.2)Conditions related to the contract
III.2.2)Contract performance conditions:

Historical Contract Non-Performance

(i)The Participant, or any partner in a JVCA, shall not have a consistent history of litigation and/or arbitration resulting in awards against the Participant, or any partner in a JVCA.

(ii)All pending litigation shall in total not represent more than 10 percent of the Participant’s net worth and shall be treated as resolved against the Participant.

Environmental, Social, Health and Safety (ESHS)

(i)Availability of a valid ISO certification or internationally recognized equivalent (equivalency to be demonstrated by Participant), such as Environmental management certificate ISO 14001; and Health and safety certificate OHSAS 18001. In absence of the above certificates, availability of in house policies and procedures for ESHS management.
