VII.2.1)Description of the modifications
Nature and extent of the modifications (with indication of possible earlier changes to the contract):

The initially awarded ceiling under DIGIT-TM lot 1 of EUR 657 596 280,00 has been increased, through Negotiated procedure no. DIGIT/A3/PN/2020/008 – ‘Negotiated Procedure DIGIT-TM Lot 1 and Lot 3’, by EUR 328 798 140,00 representing a 50 % ceiling increase of the initial budget ceiling, thus resulting in EUR 986 394 420,00 (initial ceiling + ceiling increase) – see contract award notice OJS S77-195914 of 21 April 2021.

This global ceiling is further increased by EUR 180 000 000,00, thus resulting in a new global ceiling under DIGIT-TM lot 1 of EUR 1 166 394 420,00.

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

As the direct effect of the global coronavirus crisis and the need for the adoption of rapid technological evolutions and the subsequent new policy orientations, the overall expenditure ceiling may not be sufficient to cover the needs of the European Commission until the maximum possible end date of the framework contract.
