The objective is to provide surveillance services through remotely piloted aircraft systems (RPAS) for the maritime environment. They should have a high level of deployability and availability that should permit EMSA to offer operational capability and provide additional data streams to European Union Member States, Iceland, Norway, to the European Commission, to European Union agencies and to governmental organisations.

Lot 1: medium-size, long-endurance RPAS services for pollution monitoring: this lot will focus on marine pollution monitoring and could also respond in emergency situations. The RPAS will focus on long-endurance operations, equipped with the necessary sensors needed for marine pollution monitoring but could also be used for general maritime surveillance if needed.
Lot 2: RPAS services for emissions monitoring: this lot will focus on emissions monitoring. The RPAS service would primarily be aimed at measuring the amounts of sulphur dioxide that are emitted by individual vessels.

This lot will focus on emissions monitoring. The RPAS service would primarily be aimed at measuring the amounts of sulphur dioxide that are emitted by individual vessels.

Although emissions monitoring activities are expected to be in specified sulphur emission control areas (SECAs) and approaches to the major European ports, the RPAS service for emissions monitoring can be used all over European waters. The main objective of the RPAS service is that it can assist Member States to check EU and non-EU flagged vessels which may be in transit in EU waters and ensure that they comply with the requirements of the Sulphur Directive (Council Directive 1999/32/EC of 26.4.1999 relating to a reduction in the sulphur content of certain liquid fuels and amending Directive 93/12/EEC).

Description of particular conditions: In addition to economic operators established in the Member States of the Union, only economic operators from the following countries are eligible to participate in the present procurement procedure: Albania, Bosnia and Herzegovina, the former Yugoslav Republic of Macedonia, Iceland, Liechtenstein, Montenegro, Norway and Serbia. In the case of economic operators from other non-EU member states, EMSA may, only in exceptional circumstances, accept their participation in a particular procurement procedure without creating a precedent or obligation for future participation.

III.2.1)Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers
Information and formalities necessary for evaluating if the requirements are met: To be eligible for participation in this contract award procedure, tenderers must not meet any of the following exclusion criteria:
(a) they are bankrupt or being wound up, are having their affairs administered by the courts, have entered into an arrangement with creditors, have suspended business activities, are the subject of proceedings concerning those matters, or are in any analogous situation arising from a similar procedure provided for in national legislation or regulations;
(b) they have been convicted of an offence concerning their professional conduct by a judgement which has the force of ‘res judicata’;
(c) they have been found guilty of grave professional misconduct proven by any means which the contracting authority can justify;
(d) they have not fulfilled obligations relating to the payment of social security contributions or the payment of taxes in accordance with the legal provisions of the country in which they are established or with those of the country of the contracting authority or those of the country where the contract is to be performed;
(e) they have been the subject of a judgement which has the force of ‘res judicata’ for fraud, corruption, involvement in a criminal organisation or any other illegal activity detrimental to the Union's financial interests;
(f) are subject of an administrative penalty for having been found guilty of misrepresentation in supplying the information required by the contracting authority as a condition of participation in the procurement procedure or failing to supply information, or being declared to be in serious breach of contract which is covered by the budget.

For this purpose, the declaration on honour, available on the ‘Procurement’ section on the EMSA website (http://www.emsa.europa.eu), shall be completed and signed.

The bidder shall provide a detailed curriculum vitae in the European format (http://europass.cedefop.europa.eu/en/documents/curriculum-vitae) for each key staff member (coordinating positions, pilots and any other relevant staff) and a filled-in summary table concerning the experience of staff to be working on this contract.

Regarding operational experience: letters or descriptions of projects or deployments in which the bidder and the key staff have been involved as well as a filled in summary table concerning the operational experience related to this contract.
Minimum level(s) of standards possibly required:
Project manager or lead for the contract are required to have relevant project management and operational management skills having been proven through at least 5 years with other customers.
The pilots who will be coordinating the deployments for the contract must have a minimum of 3 years' experience piloting aircraft and/or RPAS and this should be demonstrated through previous projects/deployments.
The operational, logistical, maintenance, and other ground support staff should have relevant experience having worked on RPAS deployments or similar operations.
Regarding operational experience: the company must show at least a significant number of proven flight hours with its remotely piloted aircraft being offered for the contract. This should include the flight hours already performed (target is a minimum of 500 flight hours) and/or the number of acceptance tests which have already been conducted.
