Alliance Homes is a registered provider operating in North Somerset and the surrounding areas and has previously let a Framework Agreement on behalf of itself and others as defined in the original Contract Notice (2014/S 132-236579). This framework is comprised of 4 lots as follows:

Lot 1: garage management and maintenance: South;

Lot 2: garage management and maintenance: North;

Lot 3: commercial units management and maintenance: South;

Lot 4: commercial units management and maintenance: North.

The services to be provided are associated with the management and maintenance of garage portfolios, commercial property units and other small-scale or infill sites. Such services may also include project management of re-development opportunities.

IV.1)Description
IV.1.1)Type of procedure
Award of a contract without prior publication of a call for competition in the Official Journal of the European Union in the cases listed below
  • The procurement falls outside the scope of application of the directive
Explanation:

Whereas the original Contract Notice (2014/S 132-236579) was for the provision of services with a value of between 1 000 000 GBP and 10 000 000 GBP over 4 years, the utilisation of this value has been significantly below this range. Alliance Homes has extended the term of the framework so that services covered can be called-off within the initially envisaged range, over a maximum of 2 further years. This does not affect the economic balance of the contract (toward the favour of either party) as anticipated in the original Contract Notice.

Regulation 72 of the Public Contracts Regulations allows Framework Agreements to be extended in scope where such an extension or variation is not substantial. After consideration, Alliance Homes is of the opinion that the extension is not substantial, is therefore justified and does not use the framework improperly or in such a way as to prevent, restrict or distort competition.
