Na podstawie art. 139 ust. 1 uPzp Zamawiający najpierw dokona badania i oceny ofert, a następnie dokona kwalifikacji podmiotowej Wykonawcy, którego oferta została najwyżej oceniona, w zakresie braku podstaw do wykluczenia oraz spełniania warunków udziału w postępowaniu.

Termin wykonania zamówienia: od dnia zawarcia umowy do dnia 15.05.2023 r. lub do wykorzystania maksymalnej wartości umowy, w zależności od tego co nastąpi wcześniej.

Rozpoczęcie sprzedaży (dostawy) energii elektrycznej nastąpi po dopełnieniu niezbędnych formalności tj. skutecznym zgłoszeniu umowy sprzedaży energii elektrycznej, skutecznym przeprowadzeniu zmiany sprzedawcy. 3. Kwestie dotyczące odwołania uregulowane są w art. 513–568 uPzp.

4. W niniejszym postępowaniu odwołanie do Prezesa Izby wnosi się w terminie 10 dni od dnia przekazania informacji o czynności Zamawiającego stanowiącej podstawę jego wniesienia.

5. Szczegółowy tryb postępowania przy rozpoznawaniu odwołań, szczegółowy sposób wnoszenia odwołania i innych pism w postępowaniu odwoławczym, tryb postępowania z wniesionym odwołaniem oraz sposób przygotowania rozpraw zostały określone w rozporządzeniu Prezesa Rady Ministrów z dnia 30 grudnia 2020 r. w sprawie postępowania przy rozpoznawaniu odwołań przez Krajową Izbę Odwoławczą (Dz.U. z 2020 r. poz. 2453).

6. Na orzeczenie Krajowej Izby Odwoławczej, stronom oraz uczestnikom postępowania odwoławczego przysługuje skarga do sądu. Kwestie dotyczące skargi do sądu regulowane są w art. 579–590 uPzp.
