Naročnik izvaja postopek s pogajanji z objavo po 45. člen ZJN-3.

Naročnik se bo pogajal z vsemi ponudniki za katere bo ugotovil sposobnost na podlagi oddane prijave za sodelovanje (v nadaljevanju: kandidati).

Naročnik bo pogajanja izvajal glede na gibanje cene električne energije na borzi, predvidoma v obdobju od 3. - 20. 5. 2022. V povabilu k predložitvi ponudbe bo določil prvo obdobje dobav in ocenjene količine v tem obdobju.

Rok za prejem ponudb bo naročnik s kandidati sporazumno dogovoril. Zaradi zagotovitve čim večje odzivnosti na borzna gibanja naročnik pričakuje hitro odzivnost kandidatov (oddajo ponudbe znotraj nekaj ur). Vsi kandidati bodo imeli na voljo enako časa za pripravo in preložitev ponudb.

Naročnik bo okvirni sporazum sklenil z največ tremi kandidati, ki bodo v postopku pogajanj za prvo obdobje dobav oddali najugodnejše ponudbe.

Dobavitelj v prvem obdobju dobav bo najugodnejši ponudnik.

Za nadaljnje obdobje dobav bo naročnik odpiral konkurenco med strankami okvirnega sporazuma. Dobavitelj v posameznem obdobju dobav bo tista stranka okvirnega sporazuma, ki bo oddala najugodnejšo ponudbo za obravnavano obdobje.
