1 800 pallets of white 80 g TCF paper over 4 years, i.e. 450 pallets of white 80 g TCF paper per year. Each pallet is to contain 100 000 sheets of A4-format paper. These quantities are given for information purposes only and are not binding on the part of the Court of Justice; the quantities to be ordered may vary according to the institution's needs.

III.2.2)Economic and financial ability
Information and formalities necessary for evaluating if the requirements are met: the tenderer's economic and financial capacity must be sufficient for him to carry out the contract in accordance with the contract provisions. If, in light of the information given, the Court of Justice of the European Union has serious doubts as to the tenderer's financial capacity or if the latter proves to be clearly insufficient to perform the contract, the tender may be rejected without the tenderer being entitled to any financial compensation.
For the contract referred to in this invitation to tender, the Court of Justice of the European Union requires tenderers to have a minimum financial and economic capacity, which shall be evaluated on the basis of the following:
— average annual turnover of at least 300 000 EUR over the past 3 financial years.
This capacity will be assessed on the basis of:
— copy of balance sheets, or summaries thereof, and profit and loss accounts for the past 3 financial years, together with a copy of any reports from the board of directors and external auditors, if available, relating to those financial years. If, for a valid reason substantiated by supporting documents, the candidate is unable to provide them, he must enclose a solemn declaration stating the annual profits after tax for the past 3 financial years.
III.2.3)Technical capacity
Information and formalities necessary for evaluating if the requirements are met:
tenderers' technical and professional capacity is evaluated and verified in procedures for awarding public contracts for the provision of services, with particular regard to their know-how, efficiency, experience and reliability.
The contracting authority shall verify whether the entities whose capacities the economic operator intends to use and the intended subcontractors, when subcontracting represents a significant part of the contract, meet the applicable selection criteria.
For the contract referred to in this invitation to tender, the Court of Justice of the European Union requires tenderers to prove a minimum level of capacity:
— have sufficient human and technical resources to make the deliveries of paper,
— have at least 3 years' experience of services similar to those required in the contract in question,
— have provided at least 1 500 pallets of paper over the past 3 years.
Economic operators' technical and professional capacity shall be proven by:
— description of the tendering company's technical means for making deliveries of the supplies referred to in the contract, including a description of the fleet of vehicles used for making the deliveries,
— statement as to average annual manpower over the past 3 years,
— number of years' experience of the managerial staff,
— list of the main deliveries of paper, made over the past 3 years, stating the quantities of pallets provided, dates and delivery locations.
It should be noted that any misrepresentation discovered following contract award will lead to the contract being cancelled.
The Court of Justice may conclude that economic operators shall not provide an appropriate level of quality in performing the contract if it establishes that these operators are in a situation where interests conflict, which might adversely affect contract performance.
