The contract falls outside the scope of application of the Directive.
 Es handelt sich um ein Verhandlungsverfahren ohne TW gemäß § 14 (4) Nr. 2 b) VgV. Dieses Verfahren darf durchgeführt werden, wenn der Auftrag nur von einem bestimmten Unternehmen erbracht oder bereitgestellt werden kann, weil aus technischen Gründen kein Wettbewerb vorhanden ist. Der bisherige Auftragnehmer verfügt über umfassende, teils auch nicht dokumentierte Projektkenntnisse, welche auch VS-eingestuftes Material umfassen. Vor diesem Hintergrund wäre die Einarbeitung eines neuen Auftragnehmers in das Projekt einerseits mit erheblichen und damit unwirtschaftlichen Mehrausgaben verbunden. Andererseits gebietet auch der Grundsatz der VSA „Kenntnis nur wenn nötig“, die Weitergabe von VS-Material auf den unbedingt notwendigen Personenkreis zu beschränken. Die Firma Holger Gadorosi Consulting hat seit Beginn der Projektleitung ihre hochgradige Spezialisierung im Bereich IT- und Prozessberatung und ihre herausragenden Kenntnisse auf verwaltungstechnische Abläufe in solchen Großprojekten nachgewiesen. Zusätzlich hat sie sich viel technisches Spezialwissen für dieses Projekt angeeignet. Somit ist tatsächlich kein Wettbewerb vorhanden.
