Contract awarded to supplier to provide support for the Government Gateway managed service and maintenance provision for existing hardware from 1.4.2016 to 31.3.2018. The service shall be provided to support the decommissioning Government Gateway service and shall be scaled back as required as the GG services migrate to new solutions over the term of the contract.

Award of a contract without prior publication of a call for competition in the Official Journal of the European Union in the cases listed below
  • The works, supplies or services can be provided only by a particular economic operator for the following reason:
    • absence of competition for technical reasons
Explanation:

Awarding the contract to Dell was necessary to support the decommissioning of the legacy Government Gateway service. There was no alternative supplier as Dell was the only supplier in the position to provide software support and hardware maintenance provision for the legacy service because the configuration of the service is specific to dedicated hardware devices. Dependency on these devices is critical for the operational running of the legacy service, removing or replacing these devices could cause unacceptable interoperability issues for the service and, therefore, become unavailable to multiple government departments and a large numbers of users. A number of customers also use dedicated devices to support development of their integrating services, any configuration issues relating to these devices could also impact those services. The Authority could find no reasonable alternative or substitute supplier that could provide the required services given that the service is currently being decommissioned.

Precise information on deadline(s) for review procedures:

The Public Contracts Regulations 2015 provide for aggrieved parties who have been harmed or at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought within 30 days of the date of knowledge (the date on which the economic operator first knew or ought to have known that grounds for starting the proceeding had arisen) unless the Court considers there is good reason for extending the period (up to a maximum of 3 months from the date of knowledge). If the framework agreement/contract has been entered into the Court may award damages and in the case of specified breaches of the rules may also order the termination or shortening of the framework/contract and the levying of fines.
