In temeiul prevederilor art. 160 din Legea 98/2016,modificata prin OUG 107/2017, operatorii economici interesati de procedura vor solicita clarificari sau informatii suplimentare in legatura cu documentatia de atribuire cu 20 de zile inainte de termenul stabilit pentru depunerea ofertelor, iar in temeiul art. 161 din Legea 98/2016, modificata prin OUG 107/2017, raspunsul autoritatii contractante va fi transmis cu 10 zile (in a 11-a zi) inainte de termenul stabilit pentru depunerea ofertelor.

Informatii si formalitati necesare pentru evaluarea respectarii cerintelor mentionate:

Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca în situatiile prevazute la Art. 59, 60, 164, 165 şi 167 din Legea nr. 98/2016 privind achizitiile publice.

Cerinta 1 – Informatii privind neincadrarea in prevederile art. 164, art. 165 si art. 167 din Legea nr. 98/2016 privind achizitiile publice.

Modalitate de indeplinire prin care poate fi demonstrata indeplinirea cerintei:

— se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor.

Cerinta 2 – Informatii privind neincadrarea in prevederile Art. 59 si 60 din Legea nr. 98/2016 privind achizitiile publice. Persoane cu functii de decizie in cadrul autoritatii contractante implicate in procedura de atribuire: Prof. Univ. Dr. Catalin -Florin Cirstoiu – Manager Interimar; Conf. Dr. Silvia - Corina Pop – Director Medical; Ec. Georgeta Stan – Director Financiar – Contabil; Ing. ec. Madalin Necula – Sef Serviciu Achizitii Publice.

Modalitate de indeplinire prin care poate fi demonstrata indeplinirea cerintei:

— se va prezenta odata cu DUAE o declaratie pe propria raspundere conform modelului atasat in SEAP.

Documentele justificative necesare pentru confirmarea cerintelor, vor fi solicitate de catre autoritatea contractanta doar ofertantilor clasati pe primele 3 (trei) locuri dupa aplicarea criteriului de atribuire si oricum pana la data intocmirii raportului procedurii de atribuire, acestea fiind urmatoarele:

— certificate constatatoare privind lipsa datoriilor RESTANTE cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat, etc.) la momentul prezentarii (art.196 din Legea 98/2016),

— cazierul judiciar al ofertantilor (operatorilor economici),

— cazierul judiciar al membrilor organului de administrare, de conducere sau de supraveghere al respectivului ofertant, sau a celor ce au putere de reprezentare, de decizie sau de control în cadrul acestuia, așa cum rezultă din certificatul constatator emis de ONRC / actul constitutiv,

— dupa caz, documente prin care se demonstreaza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2) si art. 171 din Legea 98/2016 privind achizitiile publice.

În cazul operatorilor economici straini se vor prezenta documente echivalente si edificatoare emise în conformitate cu legislatia tarii de origine (certificate fiscal, certificate judiciare, etc.) care sa confirme faptul ca sunt indeplinite cerintele in tara de rezidenta. Toate documentele solicitate trebuie sa fi valabile la data depunerii acestora.

Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de înregistrare în conditiile legii din tara de rezidenta, ca sunt legal constituiti, ca nu se afla în niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului. Modalitatea prin care poate fi demonstrata îndeplinirea cerintei: se va completa DUAE de catre operatorii economici (lider, asociat, tert sustinator,subcontractant-daca este cazul) participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentul justificativ care probeaza îndeplinirea celor asumate prin completarea DUAE este certificatul constatator emis de ONRC, sau în cazul ofertantilor straini, documente echivalente emise în tara de rezidenta. Înainte de atribuirea acordului cadru, autoritatea contractanta va solicita operatorilor economici (lider, asociat, tertsustinator,subcontractantdaca este cazul) clasati pe primele 3 locuri dupa aplicarea criteriului de atribuire sa prezinte documente justificative in original sau copie certificata pe proprie raspundere pentru conformitate cu originalul, prin care sa demonstreze îndeplinirea criteriilor de calificare, în conformitate cu informatiile cuprinse în DUAE.

Documentatia de atribuire este afisata in SICAP, www.e-licitatie.ro. Toate raspunsurile la clarificari cerute de catre operatorii economici sau formulate de catre autoritatea contractanta vor fi postate pe site-ul www.e-licitatie.ro. INSTRUCTIUNI PRIVIND DUAE - A se vedea documentul "Instrucțiuni pentru ofertanți" atasat prezentei documentatii de atribuire, punct 1 - INSTRUCȚIUNI PRIVIND DUAE. Fara a aduce atingere prevederilor Legii nr.182/2002 privind protectia informatiilor clasificate, cu modificarile si completarile ulterioare, operatorul economic VA PRECIZA IN OFERTA DEPUSA acele informatii cuprinse in propunerea tehnica pe care le declară ca fiind

Confidențiale. Caracterul confidențial trebuie demonstrat prin orice mijloace de probă. In lipsa documentelor care demonstreaza caracterul confidential, documentele vor fi considerate ca neconfidentiale. Avand in vedere ca autoritatea contractanta va semna acordul cadru doar cu operatorii ecomomici situati pe locul I,II, III, dupa caz, modul de departajare a ofertelor cu preturi egale se va face astfel:

1. In cazul in care comisia constata ca au fost depuse/introduse in SICAP mai mult de doua oferte admisibile cu preturi egale la ofertantii clasati pe locul 1, autoritatea contractanta va transmite prin SICAP, o solicitare de clarificare referitoare la depunerea unor noi propuneri financiare imbunatatite (cu 2 zecimale), iar operatorii economici vor transmite raspunsul lor folosind facilitatile oferite de SICAP, caz incare contractul va fi atribuit primilor 3 ofertanti care au pretul cel mai scazut.

2.In cazul in care comisia constata ca au fost depuse maimult de 2 oferte admisibile cu preturi egale de catre ofertantii clasati pe locul II, modul de departajare a acestora se va face prinsolicitarea, in SICAP, a unei noi propuneri financiare imbunatatite (cu 2 zecimale), iar operatorii economici vor transmite raspunsul lorfolosind facilitatile oferite de SEAP, astfel incat ofertantul clasat pe locul I sa nu fie afectat, respectiv noua propunere financiara sa nu fieegala sau mai mica decat oferta clasata pe locul I.

3.In cazul in care comisia constata ca au fost depuse mai mult de 2 oferte admisibile cupreturi egale de catre ofertantii clasati pe locul III, modul de departajare a acestora se va face prin solicitarea in SICAP, a unei noipropuneri financiare imbunatatite (cu 2 zecimale), iar operatorii economici vor transmite raspunsul lor folosind facilitatile oferite de SICAP,astfel incat ofertantii clasati pe locul II sa nu fie afectati, respectiv noua propunere financiara sa nu fie egala sau mai mica decat ofertaclasata pe locul II.

Termenele/datele de depunere ale noilor propuneri financiare se vor comunica în solicitarea transmisa de catre autoritatea contractanta.

Autoritatea contractanta va atribui contracte subsecvente ofertantului clasat pe locul I pana cand acesta isi declara incapacitatea de a mai furniza produsele ce fac obiectul acordului cadru, situatie in care autoritatea contractanta va atribui contracte subsecvente ofertantului clasat pe locul II sau dupa caz locul III, in cazul in care ofertantul clasat pe locul II refuza semnarea contractului subsecvent sau declara incapacitate de livrare.
