Multiple framework contract with reopening of competition:
Multiple framework contract: in the event of award of the contract, a 1-year framework contract, renewable annually and with a final term fixed at 31.12.2023, will be signed with each tenderer which satisfies the exclusion and selection criteria, and which has proved to have all the necessary authorisations, in accordance with the provisions of Decree No. 2011-1457 of 7.11.2011 on the authorisation to exercise the activity of buying electricity for resale, as well as all legal texts published or to come, relating thereto.
Reopening of competition: in the event of a specific order, the European Parliament and the Agency eu-LISA individually and respectively reserve the right to reopen competition for the signatories of the framework contract, with a view to signing a specific contract for the supply over a term that can vary from 12 to 36 months, at the choice of the participating institution. To this end, all economic operators who have signed a framework contract may be invited to submit a price offer which will be evaluated on the basis of the award criteria defined in the specifications.
Each of the participating institutions may proceed with any new reopening of competition with a view to signing a new specific supply contract. The total duration of all the specific contracts per participating institution may not exceed 48 months.
