Provision of Canteen and Catering Services at Eurofound
The main purpose of this procedure was to contract a friendly, efficient provision and timely delivery of high-quality canteen and catering services at Eurofound as outlined in the tender specifications. The main purpose of the hospitality service is to provide balanced, healthy and tasty food to staff and its visitors.
The tasks are to be performed at the Eurofound premises in Dublin (Ireland).
The contractor is expected to provide the following services to Eurofound:
— on-going staff service (both breakfast and lunch) in the canteen. Three levels of service are envisaged (options): minimum, medium, maximum;
— ad-hoc catering service for conferences, meetings and other events.
The contractor is expected to provide on-going staff services (breakfast and lunch) in the following ways:
— minimum level of service: one member of canteen staff catering for c. 20 % of Eurofound staff;
— medium level of service: two members of canteen staff catering for c. 40 % of Eurofound staff (option 1);
— maximum level of service: two members of canteen staff catering for c. 60 % of Eurofound staff (option 2).
Eurofound relies on the following assumptions:
— contract implementation will start at medium level of service (option 1);
— minimum level of service to be possibly in place over the 6 months;
— medium level of service to be possibly in place over the 24 months;
— maximum level of service to be possibly in place over the 18 months.
TUPE or the Transfer of Undertakings Directive of 1977, which became part of Irish law by the European Communities (Safeguarding of Employees' Rights on Transfer of Undertakings) Regulations, 1980, protects the rights of employees where the business in which they are employed is transferred to a new owner, and is applicable to this contract. Within two months of notification of the outcome of the procedure (award decision), tenderers may launch an action for its annulment. Any request tenderers may make and any reply from Eurofound, or any complaint for maladministration, will have neither the purpose nor the effect of suspending the time-limit for launching an action for annulment nor open a new period for launching an action for annulment. The body responsible for hearing annulment procedures is indicated under Heading VI.4.1) of the contract notice.
