III.1)Conditions for participation
III.1.1)Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers
List and brief description of conditions:

— Document for registered activity In order to establish its capacity for performance of professional duty, the economic operator should submit a document for registered business as evidence that it is registered as a physical or legal entity for performance of activities related to the subject of the public procurement agreement or evidence that the operator belongs to an adequate professional association, in accordance with the regulations of the country where the operator is registered,

— In the course of establishing the capacity of the operator to perform professional activity, the contracting authority shall require from economic operators to submit evidence issued by the competent body on completed special conditions for performance of activity, as prescribed by law, which are related to the subject of the agreement, in this case the provider, in accordance with the Law on Electronic communications must be registered in the official records of AEC.

In order for an economic operator to evidence capacity for performance of professional activity, they must provide the following:

— A document for registered activity,

— Certificate on completed registration by the official AEC records.

III.1.2)Economic and financial standing
III.1.3)Technical and professional ability
List and brief description of selection criteria:

— The provider must have employed or contracted professional qualified staff for the service subject of this public procurement, certified for management and maintenance of their telecommunication network, as follows: At least 5 (five) employees, engineers with at least 2 (two) telecommunication engineers, specialized for maintenance of communication equipment used for the services provided in this public procurement,

— The provider must provide at least 3 persons with their contact information, which shall be available in case of interruption of the service, during the interruption, and until removal thereof,

— The provider must own a certified telecommunication network with designated transmission characteristics, with the following minimum properties: Delay of IP packet of maximum 200 milliseconds transatlantic connection, 80 milliseconds for European connections, losses of IP packet of maximum 1 % monthly,

— The provider must have interconnections with at least two other domestic internet services providers, with total capacity of connections of at least 2Gbit/ѕ,

— The provider must have available the necessary equipment and minimum 2 (two) independent international optic connections with transmission capacity from each of the connection towards external operators of at least 20Gbit/ѕ in both directions.

The economic operator shall prove the fulfillment of the minimum conditions by submitting the following documents:

Statement from the Employment Agency, not older than 15 days from announcing the public procurement or engagement contracts proving that the operator has provided qualified personnel for the service subject of this public procurement. Certificates for the employees or engaged staff that they have been certified for management and maintenance of their telecommunication network, as follows: At least 5 (five) employees or contracted engineers, of which at least 2 (two) telecommunication engineers, specialized for maintenance of communication equipment used for the services provided in this public procurement:

— Statement on nomination of (at least three persons) with direct contact information (not technical support), mobile phone number, fixed telephone number, e-mail. In case of interruption of the service, the nominated/assigned persons shall be available during the interruption and until it is removed, according to the tendering documentation provided as a supplement of this call

— A copy of ЅLA (Service level agreement) from active contracts with designated transmission characteristics, with the following minimum properties: Delay of IP packet of maximum 200 milliseconds transatlantic connection, 80 milliseconds for European connections, losses of IP packet of maximum 1 % monthly,

— Copies of active contracts for interconnections with at least two other domestic internet services providers, with total capacity of connections of at least 2Gbit/ѕ. According to the tendering documentation provided in supplement,

— Copies of active contracts by at least two independent international operators with total capacity of at least 20 Gbрѕ symmetrical (10G down + 10G up). According to the tendering documentation provided in supplement.

So as to evidence the meeting of the criteria concerning the personal situation, the economic operator shall submit the following documents:

— Statement proving that in the last 5 years the operator has not been subject to an enforceable court decision on committed crime, according to article 88, paragraph 1 from the Law on Public Procurement,

— Certificate that there is not bankruptcy procedure, issued by a competent body,

— Certificate that there is no liquidation procedure, issued by a competent body,

— Certificate on paid taxes, contributions and other public duties, issued by the competent body in the country where the economic operator is registered,

— Certificate from the Registry of penalties for committed crimes by legal entities that there is no ban for the legal entity for participation in public tendering procedures, awarding public procurement contracts and public-private partnership contracts,

— Certificate from the Registry of penalties for committed crimes by legal entities that there is no penalty in the form of temporary ban or permanent ban on performing certain activity,

— Certificate establishing that there is no valid legal sentence declaring a misdemeanor sanction - ban against performing a profession, activity or duty, i.e. temporary ban against performance of certain activity,

— Standards for Quality assurance systems: -ISO 9001: 2015 as evidence for the quality systems standard, the operator shall prove fulfilment of these standards by submitting:

— A copy of a valid Certificate ISO 9001.
