Provision of CORA Sequence Related ICT Development Services on Time and Means Basis
In the context of the implementation of the annual ICT work-programs with specific relation to development, integration and maintenance of enterprise ICT software platform, F4E needs to periodically contract specialist development services to provide support in the domain of CORA Sequence on a Time and Means Basis.
F4E’s premises in Barcelona, Spain. Occasionally and subject to F4E prior written agreement, the services may be performed remotely.

12 months renewable up to 3 times for a total maximum duration of 48 months.
Section III: Legal, economic, financial and technical information
Tenderers shall provide a declaration on their honour on exclusion and selection criteria, duly signed and dated, stating that they are not in one of the situations listed in Annex 04 of the Invitation to tender, based on the template provided therein. The tenderer to whom the contract is to be awarded shall provide the evidence documents mentioned in the same Annex 04 before the signature of the contract while proving that they are not in one of those situations.
Further, the tenderers shall submit, together with Legal Entity Form, copies of official supporting documents (register(s) of companies, official gazette, VAT registration, etc.).
Section IV: Procedure
F4E premises in Barcelona (C/ Josep Pla 2, Torres Diagonal Litoral B3, 08019 Barcelona, Spain). If as a result of the disruptions caused by the Covid-19 pandemic, physical presence for the public tender opening cannot be allowed, the public tender opening will take place by video conference on the same date and time.
An economic operator may appoint a maximum of 2 representatives to attend the public tender opening. Their full names and ID or passport numbers must be sent at the latest on the day of the submission deadline to email@example.com
The identity of the representatives will be checked at the F4E reception desk or by any other appropriate means on the day of the public tender opening.
Section VI: Complementary information
Likely to follow a 4-years cycle.
The tenderers are informed that the awarded contract will not be signed in paper. Signature of the contract will take place through a web-based F4E tool called Deviation, Amendment and Contract Changes (DACC). The contract must be signed by the tenderer's legal representative in DACC. Signature of the contract in DACC is considered equivalent to a paper document with handwritten signature and shall be admissible as evidence in legal proceedings. it is legally binding.
2) This notice and the rest of the procurement documents will be published on the F4E's Industry Portal. Tenderer's requests for clarifications will only be admitted and the answers published only there. Economic operators are strongly advised to regularly visit the webpage indicated in Section I of this notice;
3) This procurement procedure is governed by the rules laid down by:
(a) Directive 2014/24/EU;
(b) Regulation (EU, EURATOM) 2018/1046; Referred to as the ‘General Financial Regulation’ (GFR); and
(c) complemented, where it derogates, by the Financial Regulation of Fusion for Energy adopted by the Governing Board decision on 10 December 2019.

4) Tenderers can only submit a tender via e-Submission tool detailed in procurement documents;
5) The maximum contract value for the total duration of 4 years cannot exceed EUR 750 000.00. In accordance with point 11 of Annex I of the GFR, Fusion for Energy may use the negotiated procedure without prior publication of a contract notice in order to award new contract(s) consisting of a repetition of similar works or services to the contractor chosen as a result of the present call for tender, in which case the amount to be awarded under that procedure will not exceed 50 % of this contract. Such a right will be exercised by F4E in case/in the event that/should one of the following circumstance occur: in case the maximum FWC value is reached before the expiration of the FWC due to unforeseen increase of contract consumption.
Within 2 (two) months of notice of the award decision, you may launch an action for annulment of the award decision. Any request you may make and any reply from us, or any complaint for maladministration, will have neither the purpose nor the effect of suspending the time-limit for launching an action for annulment or to open a new period for launching an action for annulment. The body responsible for hearing annulment procedures is indicated in Section VI.4.1 of the contract notice. If you believe that there was maladministration, you may lodge a complaint to the European Ombudsman within 2 years of the date when you became aware of the facts on which the complaint is based (see http://www.ombudsman.europa.eu).
