II.2.4)Description of the procurement:

The following activities are included in the scope of the implementation of each step, namely ‘Rasovo’ and ‘Nova Province’, the following activities:

— Exploration for and provision of the necessary output data,

— Hydrological, geological and hydro-geological studies only for stage A New Provadia,

— Development of investment projects at the ‘Technical design phase’,

— Vote on the technical projects by the contracting authority, the consultant under Article 166 (1) of the Spatial Planning Act (ZUT), the competent control authorities, the operating companies and any other interested party,

— Approval of technical projects and production of building permits,

— Pre-detection of building sites — development of a ‘Safety and Health Plan (CKD) and Construction Waste Management Plan (PPCB) and approval under the SPA,

— Processing of the documentation of the properties concerned in the construction and rescue, archaeological surveys, the identification of owners or users/tenants of land, the establishment of the amount of the benefits for destroyed land and/or loss of land and/or damage during construction and/or rescue archaeological surveys, according to market assessments by a licensed independent valuer (agreed by the contracting authority) and performance of the compensation procedures, in accordance with the provisions of the Energy Act (ZE), the Cultural Heritage Act (ZCN) and the ZUT, which are paid by the contracting authority,

— Implementation of investment projects in the ‘Work Project’ phase,

— the composition of the work projects by the contracting authority, the consultant under Article 166 (1) of the Spatial Planning Act (ZUT), the competent control authorities, the operating companies and any other interested party,

— Suspension work, including renting of land, construction of temporary equEntity bases, provision of temporary power supplies and other temporary connections and communications, mobilisation and demobilisation, etc.,

— Supply of the necessary materials and equipment, spare parts, special tools and attachments, accompanied by the relevant documentation,

According to the “Rasovo” AC, 3 numbers of YPTs in configuration 2 are to be installed in configuration of the number of operated GTTMs and 1 spare GTKA units with a nominal capacity of 12 MW each.

In configuration ‘Nova Province’, 4 GHTCA counts are foreseen in configuration 3, in configuration the number of employees, and 1 in nominal capacity, with a nominal capacity of 10 MW each.

In order to implement the interconnection of each of the phases to the transmission network of Bulgartransgaz EAD, it is planned to design and build an input and output loop and an optical cable line, and to connect them to the networks of technical infrastructure — design and construction of road connections, electricity supply, water and sanitation, etc.

The scope and requirements are detailed in the Technical Specifications and its annexes, part of the tender documentation.

Section III: Legal, economic, financial and technical information

III.1)Conditions for participation
III.1.1)Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers
List and brief description of conditions:

The participant/consortium that will carry out works and, subject to the allocation of the persons’ participation in the performance of the activities stipulated in the consortium agreement, must be entered in the Central Professional Register of Constructors (RSPC) of the House of Constructors in Bulgaria for the implementation of the construction works under the “First Group”, “First category”, in accordance with Article 5 (6) of the draft Act.

In the event that the participant is a foreign natural or legal person, it shall be registered in a similar register in accordance with the legislation of the Member State in which he is established or has the right to do so under the legislation of the Member State of the European Union, or of another State which is a party to the European Economic Area Agreement or the Swiss Confederation.

In the case of a designated subcontractor for execution of works, it should be entered in the Central Professional Register of Constructors (RSPC) of the BG Construction Chamber for their execution. If the subcontractor is a foreign person, he must be entered in a similar register, under the legislation of the Member State in which he is established or have the right to do so under the legislation of the Member State of the European Union, or of another State which is a party to the Agreement on the European Economic Area or the Swiss Confederation.

When submitting a tender, participants shall declare compliance with the aptitude requirement (CoC) for the pursuit of a professional activity by indicating the answer ‘Yes’ in Part IV, section ‘A’ — ‘Fitness’ of the eESPD, a link to the relevant database where the information on the entry of the participant in the required professional register is accessible, should it be available and accessible to the public.

Prior to the conclusion of a public contract, the contracting authority shall require that the fulfilment of the aptitude selection (aptitude) criterion for the exercise of his/her professional activity (in the case of a consortium and depending on the allocation of the persons’ participation in the performance of the activities of the consortium)/sub-contractors to be submitted by the contracting entity (in case of reunification of works and, depending on the type of construction works), to present a copy of a valid document from the Chamber of Constructors to the Bulgarian Builders (certificate and counterfoil) certifying an entry in the Central Professional Register of the Builders for the execution of: construction under “First Group”, “First category”. The requirement applies also in case the tenderer (s) designated as implementing agent (s) are foreign persons.

Documents proving the fulfilment of the aptitude test (aptitude) for carrying out a professional activity are submitted by the contracted participant prior to the award of a public contract.

III.1.2)Economic and financial standing
List and brief description of selection criteria:

The participant shall have completed, for the 3 last completed financial years, a minimum total turnover calculated on the basis of annual turnover.

When submitting a tender, participants shall declare compliance with the minimum economic and financial requirement by completing the information in the relevant box of Part IV, Section ‘B’ — ‘Economic and financial standing’ of the eESPD.

Prior to the conclusion of the contract, compliance with the selection criterion shall be demonstrated by presentation of one or more of the following documents:

— Banking attestations,

— Annual financial statements or their constitutive parts where publication is required under the law of the country in which the participant is established;

— Overview of the total turnover.

Minimum level(s) of standards possibly required:

The tenderer shall have incurred a minimum total turnover of BGN 300 000 000 (three hundred million) or their equivalent in the currency specified by the participant in the official exchange rate of the BNB on the final date for receipt of tenders in connection with Article 61 (1) (1) of the Public Procurement Act.

The data should cover the last 3 (three) financial years closed. The information may also cover a shorter period depending on the date on which the participant was established or commenced operations.

III.1.3)Technical and professional ability
List and brief description of selection criteria:

1 The participant, on the basis of Article 63 (2) of the ZOP, has carried out activities of an object and volume which is identical or similar to those of the contract, in the investment project, for the last 5 (five) years from the date of submission of the tender.

When submitting a tender, participants shall declare compliance with the minimum requirement by completing all required information in the relevant box of Part IV, Section C — Technical and professional ability of the eESPD.

Prior to the conclusion of the contract, compliance with the selection criterion shall be demonstrated by means of a presentation of a list of the services (design) identical or similar to the subject-matter of the contract, with an indication of the values, dates and recipients, together with the documents proving that the investment project was approved/accepted by the recipient and/or has been agreed with all competent authorities and/or documents by a competent authority to confirm that the investment project has been approved/agreed with all competent authorities and/or information document that, on the basis of the developed investment project, the project can be built according to the legislation of the country where the project was approved.

In case of participation of associations which are not legal persons, compliance with the selection criterion referred to in subparagraph 1 shall be demonstrated by the consortium and not by any of the persons included therein.

2 The participant has performed activities that have an object and volume which is identical or similar to those of the contract in the construction part of the last 5 (five) years from the date of submission of the offer.

When submitting a tender, participants shall declare compliance with the minimum requirement by completing all required information in the relevant box of Part IV, Section C — Technical and professional ability of the eESPD.

Prior to the conclusion of the contract, compliance with the selection criterion shall be demonstrated by the presentation of a list of works identical or similar to the subject matter of the contract, accompanied by certificates of satisfactory execution containing the value, the date on which the implementation, the place, the type and the volume is completed, and whether it is complied with in accordance with the regulatory requirements.

In case of participation of associations which are not legal persons, compliance with the selection criterion referred to in subparagraph 2 shall be demonstrated by the consortium and not by any of the persons included therein.

3 The participant shall have staff and management staff with specified professional competence to perform the contract.

When submitting a tender, participants shall declare compliance with the minimum requirement by completing the required information in the relevant field of section ‘C’ — the ‘technical and professional ability’ of the eESPD, giving, for each of the experts declared, the names of the person and all the information required for staff and managerial staff with specific professional competence for the assessment of compliance with the minimum requirement.

Prior to the conclusion of the contract, compliance with the criterion set shall be demonstrated by the submission of a list of the staff to be performed and to the members of the managerial staff who will be responsible for the performance, specifying the professional competence of the persons, as well as documents proving the professional competence of the persons.

In case of participation of associations which are not legal persons, compliance with the selection criterion referred to in subparagraph 3 shall be demonstrated by the consortium and not by any of the persons included therein.

Minimum level(s) of standards possibly required:

1 The participant has completed at least one identical or similar activity to the contract in the investment design for the last 5 (five) years from the date of submission of the tender.

The term “activity similar to the subject and the volume of the contract” means implemented services which include an elaborated and approved investment project (technical and/or work) for:

(a) execution of new construction of a compressor station (s) for natural gas to the gas pipeline high pressure (operating pressure exceeding 1,6 MPa) incorporating the delivery, installation and operation of at least two low-emission gas-fuelled units having a single mechanical power of at least 8 MW each;

And/or

(b) reconstruction of a compression plant (s) for natural gas to a gas pipeline high pressure (operating pressure exceeding 1,6 MPa) comprising the supply, installation and operation of at least two low emission gas turbo-charged units with a single mechanical power of at least 8 MW each.

For an investment project drawn up and approved (technical and/or working), one will be accepted and approved/agreed with the recipient and/or all competent authorities and/or on the basis of which construction permission can commence (construction permit has been issued).

For an investment project elaborated and approved, it shall be executed by foreign participants that is made in a phase which is approved/agreed by the recipient and/or all competent instances and/or on the basis of which it can start construction under the legislation of the country where the project is approved.

2 The participant has completed at least one identical or similar activity in that of the contract for the last 5 (five) years from the date of submission of the tender.

Under “activity similar to the subject and the volume of the contract”, the works part of the contract is to be understood as an activity (s):

(a) new construction of a compression plant (s) for natural gas to the gas pipeline high pressure (operating pressure exceeding 1,6 MPa) including the supplied, installed and operated of at least two low-emission gas-fuelled units having a single mechanical power of at least 8 MW each;

And/or

(b) reconstruction of a compression plant (s) for natural gas to a gas pipeline high pressure (operating pressure exceeding 1,6 MPa) including the supply, installed and in operation of at least two low-emission gas-fuelled units having a single mechanical power of at least 8 MW each.

A signed statement of findings ascertaining the suitability for acceptance of the works will be accepted for the execution of the works (robbery. Protocol establishing suitability for construction work (round), or the signed protocol. 16) either a permit issued for use or an equivalent document for an object executed outside the country.

3 The participant must have staff and management staff that will be engaged in performing the contract with a specific professional competence, as follows:

3.1 A project manager, a minimum of 1 (one) person with an acquired degree, at least “bachelor”, professional qualification “engineer”; Head of project or Head of site or Technical Manager of a site completed for new construction and/or reconstruction of a compressor station for natural gas.

A finished object is understood as an object that has a signed legal act establishing the suitability for acceptance of the work (round. Protocol establishing suitability for construction work (round), or the signed protocol. 16) either a permit issued for use or an equivalent document for an object executed outside the country.

III.1.4)Objective rules and criteria for participation
List and brief description of rules and criteria:

1.Participants in the procedure shall comply with the requirements of Article 10 (1) PPA.

2 The circumstances referred to in Article 54 (1) and Article 55 (1) (1) of the PPA shall not be available for the participant in the procedure or any subcontractor specified by it. The contracting authority shall exclude from participation in a public procurement procedure a tenderer for whom there are circumstances under Article 54 (1) of the Public Procurement Act (ZOP), Article 55 (1) (1) of the Public Procurement Act and the circumstances referred to in Article 3 (8) of the Act on Economic and Financial Relations with companies registered in preferential tax regime jurisdictions, the persons controlled by them and their beneficial owners, and that the circumstances under Article 69 (1) and (2) in conjunction with Article 6 (1) (40) of the Law on combating corruption and confiscation of illegal property and under Article 107 of the Public Procurement Act (ZOP) should not be present.

3.The participants must submit the ESPD in electronic form in accordance with Article 67 (4) PPA and the Methodological Guideline of the Public Procurement Agency.

When signing the contract, the participant designated shall submit a performance guarantee at the rate of 5 % of the value of the contract for a period of 2 months after the signature of a Specific Act. 15 for the longer implementation phase in the form of a monetary amount, a bank guarantee (model O9) or an insurance. The contracting authority shall release the relevant part of the guarantee 2 months after the signature of a statement of findings. 15 for the stage concerned.

To cover 100 % of the funds advanced in advance by the contracting authority for the stage concerned, the contractor shall lodge a security for the period of 1 month following the date on which the statement of evidence was signed. 15 for the relevant phase, in one of the following forms: as a sum of money; a bank guarantee, in accordance with the bank guarantee for advance payment or insurance. The amount of the advance shall be no more than 40 % of the total price of the two stages.

A.The estimated value of the contract referred to in point II.1.5), in point II.2.6 respectively), includes the cost of making the cost of the contract over a 24 month period more expensive.

The indicator price as referred to in point II.2.5 is referred to in point II.6. — We are charged a total price for carrying out all the activities within the subject matter of the contract with a weighting of 40 t; P7 — Additional cost in relation to staggered payment with a weight of 10 t (the proposed appreciation rate in connection with the deferral should not exceed 5.00 %. The contracting entity shall remove from participation in the procedure a proposed percentage of more than 5.00 %.); P8 — Assessment of running costs of maintenance, planned repairs and fuel gas (P8 = R81 + P82), weighing 10 t according to the Methodology.

C. Extension of Item III.1.3):

3.2 A designer of a technical part, at least 1 (one) person, that it has full privileges under the ZKAIIP, regularly taken into account in 2019, or a recognised professional qualification, in accordance with the ZPPK or equivalent; experience in the development of a minimum of 1 (one) investment project for an establishment in the field of the energy sector.

In case more than one designer is proposed, the requirement shall be binding on the lead designer empowered to sign the investment project.

For an investment project, an investment project (‘Technical and/or work’) will be accepted and approved/agreed with the recipient and/or all competent authorities and/or on the basis of which construction can commence.

3.3.technical managers — minimum 2 (two) persons having performed the functions of Head of Site or Technical Lead on a completed site for new construction and/or reconstruction of a compressor station for natural gas.

3.5 Welders — minimum 10 (ten) persons — to be entitled to a ‘pipe welder’ for the ‘111’ process (certified according to BDS EN ISO 9606-1: ‘Qualification for a qualification of weldability’) Part 1: “or equivalent standard”, as 6 (six) of the specified persons also possess the capacity “pipe welding” for process “141” (certified according to BDS EN ISO 9606-1: ‘Tested for welders’ qualification.
