Numarul de zile pana la care se pot solicita clarificari inainte de data-limita de depunere a ofertelor sau candidaturilor este de 10 zile. Autoritatea contractanta va raspunde in mod clar si complet tuturor solicitarilor de clarificare sau informatiilor suplimentare in termen de trei zile lucratoare de la data primirii lor. Orice solicitare de clarificare trebuie postata in SICAP.

Pentru declaratiile de la art. 164-167, operatorii economici (lider, asociat, tert sustinator) vor completa cerinta corespunzatoare in formularul DUAE.

— Declaratie pe propria raspundere privind neincadrarea in prevederile art. 59, 60 din Legea 98/2016 privind achizitiile publice. Operatorul economic (lider, asociat, tert sustinator, subcontractant) va completa cerinta corespunzatoare in formularul DUAE. Modalitatea prin care poate fi demonstrata indeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe primul loc, in clasamentul final, intocmit la finalizarea evaluarii ofertelor;

— Certificat de atestare fiscala (inclusiv privind plata contributiilor sociale) pentru persoane juridice, eliberat de ministerul Finantelor Publice sau unitatile sale subordonate care au calitatea de creditor bugetar. Se vor prezenta documentele justificative (certificatele fiscale) actualizate prin care demonstreaza indeplinirea criteriilor de calificare in conformitate cu informatiile cuprinse in DUAE care trebuie sa ateste lipsa datoriilor restante la momentul depunerii acestora. Modalitatea prin care poate fi demonstrata indeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Modalitatea prin care poate fi demonstrata indeplinirea cerintei: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe primul loc, in clasamentul final, intocmit la finalizarea evaluarii ofertelor;

— Cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic sau al celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC/actul constitutiv. Operatorul economic (lider, asociat, tert sustinator, subcontractant) va completa cerinta corespunzatoare in formularul DUAE. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe primul loc, in clasamentul final, intocmit la finalizarea evaluarii ofertelor;

— Operatorii economici care depun oferta trebuie sa dovedeasca o forma de inregistrare si, dupa caz, de atestare ori apartenenta din punct de vedere profesional, in conformitate cu cerintele legale din tara in care este stabilit operatorul economic din care sa reiasa faptul ca operatorul economic este legal constituit, nu se afla in niciuna dintre situatiile de anulare a constituirii sale, precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului.

Informatii privind persoane juridice/fizice straine: documentele prezentate vor fi însotite de traducerea realizata de un traducator autorizat. In cazul unei asocieri, documentul trebuie prezentat de fiecare asociat, pentru partea de contract pe care o realizeaza.

Autoritatea contractanta va accepta la momentul depunerii ofertelor DUAE, ca dovada preliminara care confirma ca operatorul economic in cauza indeplineste conditiile/criteriile asumate prin completarea DUAE, urmand ca inainte de atribuirea contractului, ofertantul clasat pe primul loc dupa aplicarea criteriului de atribuire sa prezinte documentele justificative actualizate.
