Apartado IV: Procedimiento
Ship Acquisition, which is part of the UK Ministry of Defence (“the Authority”), proposes to place a 2 year contract with an estimated contract value of 400 000 GBP with Aerius Marine GmbH (company number: I8566) (the “Company”) for the provision of insurance spares for the Exhaust Machinery Fans and ACP equipment manufactured by the Company and installed on the Queen Elizabeth (QE) Class Aircraft Carriers. These components include the various sub-assembly components that make up the equipment, including the ACP condenser, evaporator, controller and compressor as well as the exhaust, supply and main machinery fans.
It is considered that this contract can be placed using the Negotiated Procedure without Prior Publication of a Contract Notice pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011) for technical reasons. This is because the Company is the Original Equipment Manufacturer of the equipment, the Ship Technical Specification requires these component spares to meet the specifications for the equipment manufactured by the Company and only the Company has access to the specific technical knowhow and technical design and manufacturing data required to manufacture these specialised component spares for the equipment.

The Authority reserves the right to amend any condition related to security of information to reflect any changes in national law or government policy. If any contract documents are accompanied by instructions on safeguarding classified information (e.g. a Security Aspects Letter), the Authority reserves the right to amend the terms of these instructions to reflect any changes in national law or government policy, whether in respect of the applicable protective marking scheme, specific protective markings given, the aspects to which any protective marking applies, or otherwise.
