The service will include scheduled on-site maintenance visits and 24/7 off-site response and support.

The Council currently has BEMS (Building Energy Management Systems) installed in 80 locations across its property portfolio including schools, office accommodation, community and leisure centres. The primary function of the BEMS is to facilitate efficient control and monitoring of building mechanical and electrical services via a remote hub thereby delivering energy savings whilst maintaining the optimum environment for building occupants.

II.2.4)Description of the procurement:

North Lanarkshire Council wishes to establish a contract for the provision of servicing and maintenance support to cover the Council's BEMS (Building Energy Management Systems) network to include 80 existing systems across the North Lanarkshire Council Estate including North Lanarkshire Leisure properties and a further 58 new systems proposed over the contract term. III.1)Conditions for participation
III.1.1)Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers
List and brief description of conditions:

If required by the member state, bidders are required to be enrolled in the relevant professional or trade registers within the country in which they are established.

Where it is required within a bidder's country of establishment they must confirm which authorisation or memberships of the relevant organisation(s) are required in order to perform this service.

Bidders must confirm if they hold the particular authorisation or memberships.

III.1.2)Economic and financial standing
List and brief description of selection criteria:

Bidders will be required to have an average yearly turnover of a minimum of 200 000 GBP for the last 3 years.

The Council will use Equifax to assist in its determination of the Bidders financial status and requires that in addition to the above turnover limits, all Bidders evidence the equivalent of Equifax ScoreCheck Grade of D or above.

It is a requirement of this contract that bidders hold, or can commit to obtain prior to the commence of any subsequently awarded contract, the types and levels of insurance indicated below:

Employer's (Compulsory) Liability Insurance = 10 000 000 GBP (each and every claim and in the annual aggregate);

Public Liability Insurance = 5 000 000 GBP (each and every claim and in the annual aggregate);

Product Liability Insurance = 5 000 000 GBP (each and every claim and in the annual aggregate).

Minimum level(s) of standards possibly required:

Bidders must provide their average yearly turnover over the last three years and as detailed in the contract notice this figure must be in excess of 200 000 GBP. Bidders who commenced trading within the last three years and therefore unable to provide information for the timeframe stipulated must detail the date they started trading within their submission. Any Bidder unable to demonstrate the required turnover to the Councils satisfaction of the Council will be excluded.

It is recommended that Bidders review their own ScoreCheck Grade in advance of returning their Bidders Submission. If, following this review, Bidders consider that the ScoreCheck Grade does not reflect their current financial status; the Bidder should give a detailed explanation at Question 4B.6 of the ESPD within the Bidders Response, together with any relevant supporting independent evidence. The Council will review any such information as part of the evaluation of Bidder's financial status.

Where the Bidder is under no obligation to publish accounts and therefore does not have a ScoreCheck Grade or equivalent rating, they must provide their audited financial accounts for the previous two years as part of their Bidders Submission in order that the Council may assess these to determine the suitability of the Bidder to undertake a contract or contracts of this size. This assessment will consider whether or not the there is any significant financial risk identified.

Bidders are further required to confirm that they have or can commit to obtaining, prior to the commencement of the contract, the levels of insurances stated above.

Bidders will be required to provide examples that demonstrate that they have the relevant experience to deliver the services/supplies as described in part II.2.4) of the OJEU Contract Notice or the relevant section of the Site Notice.

Bidders will be required to confirm whether they intend to subcontract and, if so, for what proportion of the contract.

Minimum level(s) of standards possibly required:

Bidders will be asked to demonstrate that have relevant experience to deliver the services/supplies in relation to this procurement. Bidders must be able to provide examples, to the satisfaction of the Council showing experience within the last 3 years. Any Bidder unable to fulfil this requirement will be excluded.

Bidders will also to confirm whether they intend to subcontract and, if so, for what proportion of the contract.

If the bidder has decided to subcontract a part of the contract and relies on the subcontractor's capacities and capabilities to perform that part then a separate ESPD for such subcontractors must be completed. This question should not be scored.

The Contractor shall ensure that all contracts with Subcontractors and Suppliers which the Contractor intends to procure following the Commencement Date, and which the Contractor has not, before the date of this Contract, already planned to award to a particular Subcontractor or Supplier, are advertised through the Public Contracts Scotland procurement portal (www.publiccontractsscotland.gov.uk) and awarded following a fair, open, transparent and competitive process proportionate to the nature and value of the contract.

Under the terms of this contract the successful supplier(s) will be required to deliver Community Benefits in support of the authority's economic and social objectives. Accordingly, contract performance conditions may relate in particular to social and environmental considerations. The Community Benefits included in this contract are:

The Bidder and its supply chain will be required to actively participate in the achievement of social, environmental and/or sustainability policy objectives relating to local regeneration, social and economic growth, recruitment, employment and training and supply chain initiatives.

The Bidder will be required to provide access to opportunities to SMEs wherever possible and will advertise all subcontract opportunities linked to the contract using the Public Contracts Scotland Portal.

The Bidder will be required to ensure that all subcontractors advertise all their subcontracts as described in the contract notice. In addition, they will be required to identify and provide access to opportunities linked to the contract to social enterprises wherever possible.

Where job vacancies related to the contract arise within the Bidder organisation, they will be required wherever possible and appropriate, to provide access to employment and training opportunities aimed specifically at unemployed individuals and to use all reasonable endeavours to fill those posts with such persons. The successful Bidder should also link in where possible and appropriate to school, student, graduate and other work experience programmes.

The Council will incorporate a minimum 10 calendar day Standstill Period following electronic notification (minimum of 15 calendar days for any other means of communication) to unsuccessful applicants of the award decision. A Tenderer that suffers, or risks suffering, loss or damage attributable to a breach of duty under the Public Contracts (Scotland) Regulations 2015 may bring proceedings in the Sheriff Court or the Court of Session.
