II.1.5) Short description of the contract or purchase(s):

CHIC and EEM are looking to appoint Architects to work with a range of standard house types to design schemes including homes, (flats, houses, bungalows etc.) for social / affordable rent, shared ownership, market rent, for outright sale, for a combination of these and other tenures and property types and plot these homes to design efficient and effective scheme layouts. Architects will undertake all elements of the design up to and including, but not exclusively, obtaining detailed planning approval and undertaking the technical design of homes and ancillary buildings. which may be retail commercial mixed use or specialist in type or nature. Scheme layouts will include, but will not be limited to, the elevational treatment of properties, the layout of roads and pathways, gardens, boundary treatment, communal areas, car parking and garages. The scope of the service may also include the role and services of Principal Designer under the Construction Design and Management Regulations 2015 in relation to individual projects and to act as the Client's CDM compliance advisor in relation to such projects under those Regulations.

Any Future Member of CHIC or EEM — being a local authority i.e. County, Metropolitan (City), District, Borough Council or a Unitary Authority in England and Wales, any Arm's Length Management Organisation ("ALMO") or any statutory replacement or successor organisation managed by such local authority under a Management Agreement under Section 27 of the Housing Act 1985 (or subsequent legislation) or a Registered Provider (under the Housing and Regeneration Act 2008 or subsequent legislation) (and/or (in the case of EEM) is any NHS Trust or organisation, police authority, fire authority, ambulance trust, university, higher education or further education college or other public sector organisation) and in all cases being an organisation which has applied to join and has joined CHIC or EEM as a member in accordance with the constitutional documents of CHIC or EEM and in respect of which such organisation notice has been given to the economic operators that are a party to the Framework Agreements awarded at conclusion of the procurement exercise begun by publication of this Contract Notice that such organisation is an Authorised User. Future CHIC or EEM Members may include consortia made up of organisations which would themselves individually be a Future CHIC or EEM Member and may include any special purpose vehicle (of whatever nature) owned and controlled by the consortia members and would include in those circumstances the individual consortia members of the special purpose vehicle that own and control that special purpose vehicle; and

3 A CHIC or EEM Participant — being an organisation which is neither a current CHIC or EEM Member (as defined at 1 above) nor a Future Member of CHIC or EEM (as defined at 2 above) based within England and Wales which owns and/or maintains/manages housing stock in one or more geographic area in which it operates and is a local authority i.e.. a County, Metropolitan (City), District or Borough Council or a Unitary Authority in England or Wales or is an Arm's Length Management Organisation ("ALMO") or any statutory replacement or successor organisation managed by such local authority under a management agreement under section 27 of the Housing Act 1985 (or subsequent legislation) or is a Registered Provider under the Housing and Regeneration Act 2008 (or subsequent legislation) (and (in the case of EEM) is any NHS Trust or organisation, police authority, fire authority, ambulance trust, university, higher education or further education college or other public sector organisation) and which is itself a Contracting Authority for the purpose of the Public Contracts Regulations 2015 and in respect of which organisation notice has been given by CHIC or EEM to the economic operators that are a party to the Framework Agreements awarded at conclusion of the procurement exercise being advertised by this Contract Notice that such organisation is an Authorised User of the Framework Agreements, CHIC or EEM Participants may include consortia made up of organisations which would themselves individually be a CHIC Participant or an EEM Participant and may include any special purpose vehicle (of whatever nature) owned and controlled by the consortia members and would include in those circumstances the individual consortia members of that special purpose vehicle that own and control that special purpose vehicle.

Architects will undertake all elements of the design up to and including, but not exclusively, obtaining detailed planning approval and undertaking the technical design of homes and ancillary works and buildings which may be retail commercial mixed use or specialist in type or nature. Scheme layouts will include, but will not be limited to, the elevational treatment of properties, the layout of roads and pathways, gardens, boundary treatment, communal areas, car parking and garages. Projects may include the construction of homes manufactured off site and delivered to and erected on site including modular homes and homes constructed using frames and panels but projects may also include the construction of homes using brick and block and other traditional or and/or modern methods of construction on site. The scope of the service may also include the role and services of Principal Designer under the Construction Design and Management Regulations 2015 in relation to individual projects and to act as the Client's CDM compliance advisor in relation to such projects under those Regulations.

3 A CHIC or EEM Participant — being an organisation based within England or Wales which is neither a current CHIC or EEM Member (as defined at 1 above) nor a Future Member of CHIC or EEM (as defined at 2 above) but in all cases is a contracting authority under the Public Contracts Regulations 2015 and which owns and/or maintains/manages housing stock in one or more geographic area in which it operates and is a local authority i.e. a County, Metropolitan (City), District or Borough Council or a Unitary Authority in England or Wales or is an Arm's Length Management Organisation (‘ALMO’) or any statutory replacement or successor organisation managed by such local authority under a management agreement under section 27 of the Housing Act 1985 (or subsequent legislation) or is a provider of social housing registered as a registered provider with the Homes and Communities Agency or as a registered social landlord with the Welsh Ministers or (in the case of EEM) is an NHS Trust (which includes Acute Trusts, Mental Trusts, Care Services Trusts and Ambulance Trusts) or organisation, police authority, fire authority, ambulance trust, university, higher education or further education college or other public sector organisation and in all cases in respect of any such contracting authority organisation notice has been given by CHIC or EEM to the economic operators that are a party to the Framework Agreements awarded at conclusion of the procurement exercise being advertised by this Contract Notice that such organisation is an Authorised User of the Framework Agreements, CHIC or EEM Participants may include consortia made up of organisations which would themselves individually be a CHIC Participant or an EEM Participant and may include any special purpose vehicle (of whatever nature) owned and controlled by the consortia members and would include in those circumstances the individual consortia members of that special purpose vehicle that own and control that special purpose vehicle.

Economic operators should also note that the procurement documents will contain the opportunity for bidders to express interest in working in areas other than the geographical areas within the Lots described in the procurement documents and which will include the ability of organisations (but at the request and discretion solely of an Authorised User)to work across Lot areas where one or more economic operator appointed to a Lot advertised in this Contract Notice is unable or unwilling to undertake the scheme, or, where the scheme crosses over boundaries between the geographical region for a Lot advertised in this Contract Notice and includes the opportunity, as explained in the memorandum of Information and/or Invitation to Tender documents, for economic operators to work in areas to the north and/or south of Lots 1 and 2 i.e. the central West and East Midlands belt advertised by this Contract Notice.

VI.3) Additional information:

For the avoidance of doubt, CHIC having become a member of Re:allies Works Limited all members of that consortia existing now or at any time in the future will be regarded as CHIC Participants and as such Authorised Users entitled to access and use the Framework Agreements to be awarded at conclusion of the procurement exercise begun by publication of this Contract Notice.
