Cerința nr. 1. Ofertanții, terții susținători și subcontractanții nu trebuie să se regăsească în situațiile prevăzute la art. 164, 165, 167 din Legea nr. 98/2016 Modalitatea de îndeplinire: Se va completa DUAE în conformitate cu art. 193 alin. (1) din Legea nr. 98/2016, respectiv art. 202 alin. (1) din Legea nr. 99/2016. Documentele justificative care probează îndeplinirea celor asumate prin completarea DUAE urmează a fi prezentate, la solicitarea autorității/entității contractante doar de către ofertantii clasati pe primele trei locuri in clasamentul intermediar intocmit dupa finalizarea etapei de licitatie electronica, sunt:

- pentru sediul principal certificate fiscale cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat etc.) valabile la momentul prezentarii, iar pentru sediile secundare/punctele de lucru, se va prezenta o declaraţie pe propria răspundere. art. 165 din Legea nr. 98/2016 cu modificari si completari conf O.G. nr.3/2021

Cerința nr. 1.

Operatorii economici care depun ofertă trebuie să dovedească o formă de înregistrare în condițiile legii din țara rezidentă, din care să reiasă că operatorul economic este legal constituit, că nu se află în niciuna din situațiile de anulare a constituirii, precum și faptul că are capacitatea profesională de a realiza activitățile ce fac obiectul contractului de achiziție publică.

Modalitatea de îndeplinire: Se va completa DUAE de către operatorii economici participanți la procedura de atribuire a contractului de achiziție publică/sectorială cu informațiile solicitate de către autoritatea/entitatea contractantă - informații referitoare la îndeplinirea cerințelor privind capacitatea de exercitare a activității profesionale. Documentul justificativ care probează îndeplinirea celor asumate prin completarea DUAE, respectiv certificatul constatator emis de ONRC, sau în cazul ofertanților persoane juridice/fizice străine, documentele echivalente emise în țara de rezidență, traduse în limba română, urmează să fie prezentate, la solicitarea Autorității/entității contractante, doar de către ofertantii clasati pe primele trei locuri in clasamentul intermediar intocmit dupa finalizarea etapei de licitatie electronica În situația în care vor fi executate părți din contract de către subcontractanți, dovada înregistrării și corespondența activităților principale/secundare din cadrul acestuia cu obiectul achiziției se va prezenta obligatoriu și de către subcontractanți, pentru partea din contract pe care o vor realiza. În procedurile de atribuire a contractelor de achiziție publică/sectorială de produse care cuprind și prestarea de servicii conexe, în cazul în care este necesar ca operatorii economici să dețină o autorizație specială, sau să fie membri ai unei anumite organizații pentru a putea presta serviciile în cauză în statul de origine, sau să fie înscriși în registre profesionale, autoritatea/entitatea contractantă are dreptul de a solicita acestora să demonstreze că dețin o astfel de autorizație/că sunt membri ai unei astfel de organizații/sunt înscriși în registre profesionale. Dacă se impune avizarea/atestarea/autorizarea operatorului economic, aceasta trebuie să fie în relație directă cu obiectul principal al contractului/relevantă scopului urmărit prin încheierea contractului de achiziție publică/sectorială.

Cerința nr. 2.

Operatorii economici vor prezenta :

- Certificat constatator eliberat de O.N.R.C.in scopul participarii la procedura de achizitie. Informatiile cuprinse in Certificatul constatator trebuie sa fie reale /actuale la data prezentarii . Obiectul contractului trebuie sa aiba corespondent in codul CAEN din certificatul constatator emis de O.N.R.C. Se va depune certificatului constatator in oricare din formele: original/copie legalizata/copie lizibila cu mentiunea „conform cu originalul”..

- Autorizatie de punere pe piata emisa de catre Agentia Nationala a Medicamentului si a Dispozitivelor Medicale din cadrul Ministerului Sanatatii,conform art. 700 din Legea nr.95/2006 privind reforma in domeniul sanatatii, cu modificarile si completarile ulterioare.

Vor intra in etapa de licitatie electronica doar ofertele declarate admisibile, fiecare cu pretul evaluat de comisia de evaluare in cursul etapei de analiza si evaluare a ofertei financiare.Elementul reofertarii in cadrul licitatiei electronice: valoare maxima fara TVA in lei.Reofertarea se va realiza intr-o singura runda de 24 de ore. In cazul in care doua sau mai multe oferte clasate pe primul loc au pretul egal in urma desfasurarii etapei finale de licitatie electronica autoritatea contractanta va solicita ofertantilor cu pret egal sa faca o noua oferta financiara prin intermediul SICAP,in vederea incarcarii electronice de catre operatorii economici de documente care contin noi preturi.Informatiile care urmeaza a fi puse la dispozitie ofertantilor în cursul licitatiei electronice: numarul de participanti la licitatia electronica si pozitia in clasament. Nu se impune un pas/prag minim de imbunatatire a ofertelor in cadrul licitatiei electronice.

Pentru loturile 1-30;32,33,35-39atunci când două sau mai multe oferte au o valoare totală egală a propunerii financiare și sunt clasate pe același loc, în vederea departajării, autoritatea contractantă solicită noi propuneri financiare acestora, fără ca acest lucru să afecteze pozițiile superioare în clasament.

”Pentru loturile 31 si34 in cazul în care două sau mai multe oferte sunt clasate pe primul loc, cu punctaje egale, departajarea se va face având în vedere punctajul obținut la factorii de evaluare în ordinea descrescătoare a ponderilor acestora. În situația în care egalitatea se menține, autoritatea contractantă are dreptul să solicite noi propuneri financiare, și oferta câștigătoare va fi desemnată cea cu propunerea financiară cea mai mică”. art. 138 alin (2) si art. 139 alin. Cerintele tehnice definite la nivelul anuntului de participare, caietului de sarcini sau altor documente complementare, prin trimiterea standardelor, la un anumit producator, la marci, brevete, tipuri, la o origine sau la o productie/metoda specifica de fabricatie/prestare/executie, vor fi intelese ca fiind insotite de mentiunea ”sau echivalent”.
