Perkančiosios organizacijos sprendimas, priimtas išnagrinėjus tiekėjo pretenziją, gali būti skundžiamas teismui LR viešųjų pirkimų įstatymo VII skyriuje nustatyta tvarka. Perkančioji organizacija nagrinėja tik tas tiekėjų pretenzijas, kurios gautos iki pirkimo sutarties sudarymo dienos ir pateiktos laikantis LR viešųjų pirkimų įstatymo VII skyriuje nustatytų terminų. Perkančioji organizacija, gavusi pretenziją, nedelsdama sustabdo pirkimo procedūrą, kol bus išnagrinėta ši pretenzija ir priimtas sprendimas.
