The contractor will be required to lodge a performance guarantee of 2 % of the gross price
for the implementation of the whole of the subject of the contract.

The claim is made on the basis of VAT invoices issued by the Contractor, in the form of partial payment
within 45 days of the date of submission of the invoice VAT.

III.2.1)Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers
Information and formalities necessary for evaluating if the requirements are met: 1. In order to demonstrate the absence of grounds for exclusion from the procurement procedure in the circumstances referred to in Article 24(1) of the Public Procurement Act, the Contractor shall include with the bid:
1) a declaration of the absence of grounds for exclusion.
2), production of a recent extract from the relevant register or in the central registration and information on business where separate provisions require an entry in the register in order to demonstrate the absence of grounds for exclusion on the basis of Article 24(1), point 2, of the Public Procurement Act, issued not earlier than 6 months before the deadline for submission of tenders and, in relation to natural persons, the statements in point 2 of Article 24(1) of the law on public procurement.
3) a certificate of the Head of the Tax Office confirming that the economic operator is not in arrears
the payment of taxes or a certificate that he has obtained legal exemption, deferral or payment in instalments of arrears or full suspension of enforcement of the decision of the competent authority and dated no earlier than 3 months before the deadline for submission of tenders.
In the case of civil-law partnership requires that partners in a civil-law partnership, the undertaking is not behind with the payment of taxes to the tax office issued separately for each shareholder, as well as separate proof of a civil-law partnership.

2. If, in the case of economic operators established in the territory of the Republic of Poland, persons referred to
in subparagraphs 5 to 8 of Article 24(1) of the Public Procurement Law Act are domiciled outside Poland, the Contractor shall submit the certificate to the competent judicial authority or administrative residence concerning the criminal record of these persons to the extent specified in subparagraphs 5 to 8 of Article 24(1) of the Public Procurement Act, issued not earlier than 6 months before the deadline for submission of tenders, if in their place of residence does not issue such documents, they shall be replaced by a document containing a declaration made before a competent judicial, administrative or self-governing professional or economic body of residence of those persons or before a notary.
3. If the contractor is established or residing outside the Republic of Poland, instead of the documents referred to in point:
1), 1.2), 1.3), 1.4) and 1.6) to a document or documents issued in the country in which it is established confirming that:
a) not its liquidation or bankruptcy
(b) has fulfilled obligations relating to the payment of taxes or social security contributions and health has been provided for by law or that exemption, deferral or payment in instalments of arrears or full suspension of enforcement of the decision of the competent authority,
(c) did not take part in the tender;
2) 1.5) is a certificate issued by a competent judicial or administrative authority the place of residence or domicile of the person relates to the extent laid down in subparagraphs 4 to 8 of Article 24(1) of the Public Procurement Act.
4. The documents referred to in points 3.1 (a) and (c) and paragraph 3.2) must be dated no earlier than 6 months before the deadline for submission of tenders. The document referred to in paragraph 3.1 (b) shall be issued not earlier than 3 months before the deadline for submission of tenders.
5. If, in the country of residence of the person or in the country where the economic operator is established, does not appear to have the documents referred to in point 3 shall be replaced by the document containing a declaration in which the persons entitled to represent the economic operator lodged before a competent judicial, administrative or self-governing professional or economic body, a person’s place of residence or the country in which the economic operator is established, or before a notary. Rule 4 shall apply mutatis mutandis.
In the case of contractors jointly apply for the award of a public contract, the documents to be submitted by each of the contractors in the joint bid.
In addition, the Contractor shall include with the bid the written statement on fulfilment of the conditions laid down in Article 22(1) of the law on public procurement:
1 entitlement to carry out a given activity, or activities, if the laws require the holding them;
2 Ownership of knowledge and experience;
3 Availability of technical potential and persons able to perform the contract;
4th Economic and financial situation.
III.2.2)Economic and financial ability
Information and formalities necessary for evaluating if the requirements are met: In order to verify compliance with the conditions for participation in the tender procedure, the Contractor must submit: proof of insurance, and in the absence of any other relevant evidence proving that he is insured for civil liability in respect of its business. The Contractor must have its civil liability in respect of its business activities to cover a minimum of PLN 1 000 000 (in words: one million zlotys).
In the case of contractors applying jointly for the award of a public contract, the document referred to above must be submitted in one copy on behalf of all the contractors jointly applying for this contract (i.e. the “name and address of contractor” should be filled in by all contractors), signed by the agent established to represent those economic operators in procedures.
An assessment of the condition set out by the contractor, will be made on the basis of the documents referred to in point X of the tender specifications.
III.2.3)Technical capacity
Information and formalities necessary for evaluating if the requirements are met: In order to verify compliance with the conditions for participation in the tender procedure, the Contractor must submit:
1. A list of contracted work (knowledge and experience, to perform at least 2 contracts for a total amount of less than PLN 10 000 000 net (in words: ten million zloties) in connection with the construction, reconstruction or expansion of the facilities, technology hubs, including the preparation of at least 1 contracts of lamelowego thickener building with at least 900 m³/hour, in mines that extract coal, in the last three years prior to the deadline for submission of tenders and, if the period of operation is shorter, in that period.
An assessment of the condition set out by the contractor, will be made on the basis of the documents referred to in point X of the tender specifications.
2. A declaration of:
a) dispatching the fit and proper rules provided for the management, supervision and control of the works covered by the contract of at least 5 people, including:
1 person:
— building works in the field of building construction without restrictions in accordance with the provisions in force,
— at least the qualifications of personnel supervising operations in underground mines that extract coal, in construction, in accordance with the applicable rules,
1 person:
— the building works in installing utilities networks, electrical installations and equipment without restriction, in accordance with the applicable rules,
The qualifications required to perform the duties of the person carrying out the supervision activities in underground mines producing hard coal, with a specialisation in electrical machinery and equipment, In accordance with the provisions in force,
— a certificate of competency for the operation of equipment, installation and networks on the supervision of group 1 “D” for the operation, maintenance, installation and monitoring/measuring. For at least:
electrical equipment, appliances and networks with a voltage of not more than 1 kV,
electrical equipment, appliances and networks with a voltage of more than 1 kV
control, measurement and automatic control equipment and installations, control and security equipment and installations mentioned above.
1 person:
— the building works in installing utilities networks, installations and equipment, heating, ventilation, gas, water-supply and sewerage systems, without any restriction, in accordance with the applicable rules,
— Qualifications of the personnel supervising operations in underground mines that extract coal, in building; In accordance with the provisions in force,
1 person qualified employee health and safety services Health and safety, in accordance with the legislation in force,
1 The holder of a qualification required for the performance of the duties of the person carrying out the supervision activities in underground mines producing hard coal, in the fields of mechanical machinery and equipment in accordance with the applicable rules,
The assessment will be made on the basis of the contractor’s statement referred to in point X of the tender specifications.
Where the contractor will rely on the knowledge and experience of other entities, regardless of the legal nature of the links which it has with them, must prove to the contracting authority that it will have at its disposal the resources during the execution of the contract, in particular by providing an assurance of the undertaking by those entities to put the necessary resources at the disposal for the performance of the contract. An entity that is committed to making available is jointly and severally liable with the Contractor for damage caused by the failure of the contracting authority unless it is not at fault for not providing the resources.
In the case of contractors applying the public procurement documents
in points 1, 2 and a statement concerning compliance with the conditions set out in Article 22(1) of the Public Procurement Act should be submitted in one copy on behalf of all the contractors jointly

3. Those candidates invited to the electronic auction should be in possession of a qualified certificate for electronic signature issued in accordance with the provisions of law, as well as cooperating with the computer as described in this point a device enabling the provision of such signature.
4. In the course of an electronic auction the evaluation of tenders will be based on either:
(a) the price (gross) (weighting of 90 %, the maximum number of points — 90 — is subject to auctioning
(b) the guarantee of the machinery and equipment, together with components szybkozużywającymi (weight of 10 %, the maximum number of points to 10) — shall be exempt from auctioning.
5. The Contractor shall be required to make at the time of the auction plus the net rate of the tax on goods and services to enable the comparison of the tenders submitted.
6. The contracting authority will notify, in accordance with Article 92 of the Public Procurement Act and on the selection of the most advantageous tender.
7. The contracting authority shall inform the Contractor in writing of the selection of the most advantageous tender.
