This Invitation for Tenders follows the General Procurement Notice for this project which was published on the EBRD website, Procurement Notices (www.ebrd.com) on 19.12.2006, 25.02.2008, 14.05.2009 and 18.11.2013 and in 'Pobjeda', Montenegrin newspaper.

Railways of Montenegro for Infrastructure 'Željeznicka Infrastruktura Crne Gore AD (ZICG)', hereinafter referred to as "the Employer", intends using part of the proceeds of a loan from the European Bank for Reconstruction and Development (the Bank) towards the cost of a project to undertake emergency rehabilitation of the tunnels.

The Employer now invites sealed tenders from contractors for the following contract[s] to be funded from part of the proceeds of the loan:

The works on the Vrbnica–Bar line for tunnels rehabilitation: the tunnel no187 is located on the Belgrade-Bar railway line, between passing point Kos to Trebešica on km 353+657,39-353+895,93 (the total length of 238.54 metres), the tunnel no190 is located 7-9 km from the station Trebjesica to Kolasin on km 364+831,93-356+271,93 (the total length of the tunnel is 1440 m); the tunnel no193 is located 5-6 km from the station Trebjesica to Kolasin on km 357+235,96-357+631.96 (the total length of the tunnel is 396 m), the tunnel no205 is located 2-3 km from the station Lutovo to Kolasin on km 366+988,65-367+360,65 (the total length of the tunnel is 372 m), the tunnel no206 is located 2-3 km from the station Lutovo to Kolasin on km 367+480,35-367+802.35 (the total length of the tunnel is 322 m).

in two (2) lots, will include:

LOT 1:

Tunnel no187 at km 353+657.39 - km 353+895.93; Tunnel no190 at km 354+831.93 - km 356+271.93; Tunnel no193 at km 357+235.96 - km 357+631.96

Completion time for Lot 1 is 18 months

LOT 2:

Tunnel no205 at km 366+988.65 - km 367+360.65; Tunnel no206 at km 367+480.35 - km 367+802.35

Completion time for Lot 2 is 18 months

Works on Lot 1 and Lot 2 are to be performed concurrently.

Tenders are invited for one or more lots. Each lot must be priced separately. Tenders for more than one lot may offer discounts and such discounts will be considered in the comparison of tenders.

Tendering for contracts to be financed with the proceeds of a loan from the Bank is open to firms from any country.

To be qualified for the award of more than one lot, tenderer's tendering for more than one lot are required to demonstrate in their tenders that they meet the cumulative qualification criteria (with respect to turnover, general experience, personnel capabilities and financial position) for the number of lots for which they are seeking contract award.

To be qualified for the award of a contract, tenderers must satisfy the requirements regarding experience, personnel, equipment, financial position and litigation history, specified below:

1. General Experience.

The Tenderer shall meet the following minimum criteria:

(a) average annual turnover as prime contractor (defined as billing for works in progress and completed) over the last Five (5) years of not less than EURO Five (5) million equivalent for lot 1 and of not less than EURO Two and a half (2.5) million equivalent for lot 2.

In case of 'JVCA' (Joint Venture, Consortium or Association), the Lead Partner must meet not less than 70% of the requirement and Other Partner(s) not less than 30% of the requirement.

(b) successful experience as prime contractor in the execution of at least three projects of a nature and complexity comparable to the proposed contract within the last Five (5) years; each with a minimum value of at least EURO One million eight hundred thousand (1.8 million) equivalent for lot 1 and each with a minimum value of at least EURO Nine hundred thousand (0.9 million) equivalent for lot 2; with specific experience in installation of anchors of at least One thousand (1,000) pcs. put in place in one year and specific experience in shotcrete of at least Three hundred (300) cubic metres put in place in one year.

In case of two lots, the requirement is for each of the lot and is cumulative.

2. Personnel Capabilities.

The Tenderer shall provide suitably qualified personnel as detailed in the tender documents.

3. Equipment Capabilities.

The Tenderer shall own, or have assured access to (through hire, lease, purchase agreement, availability of manufacturing equipment, or other means) of the key items of equipment as detailed in the tender documents.

If a Tenderer presents a tender for two lots, the requirements for lot 1 and the requirements for lot 2 must be added.

4. Financial Position.

The Tenderer shall demonstrate that it has access to, or has available, liquid assets, unencumbered real assets, lines of credit, and other financial means sufficient to meet the construction cash flow for the contract for a period of 3 months, estimated as not less than EURO 500,000 equivalent for the lot 1 and not less than EURO 250,000 equivalent for the lot 2, taking into account the Tenderer's commitments for other contracts.

The audited balance sheets for the last Five (5) years shall be submitted and must demonstrate the soundness of the Tenderer's financial position, showing long-term profitability. Where necessary, the Employer will make inquiries with the Tenderer's bankers.

5. Litigation History.

The Tenderer shall provide accurate information on any current or past litigation or arbitration resulting from contracts completed or under execution by him over the last five years. A consistent history of awards against the Tenderer or any partner of a joint venture may result in failure of the application.

Tender documents may be obtained from the office at the address below upon payment of a nonrefundable fee of Euro 200 or equivalent in a convertible currency; and, should be paid to 'Željeznicka Infrastruktura Crne Gore AD' account number (IBAN) ME25510000000002214647 (Party identifier) 400876851700 EUR, SWIFT code CKBCMEPG, Intermediary bank: Commerzbank AG Frankfurt/Main, Swift address: COBADEFF for bidders from abroad or account number 510-22146-47 for bidders from Montenegro, accounts at 'Crnogorska Komercijalna Banka AD, Podgorica'.

Upon receipt of appropriate evidence of payment of the non-refundable fee, the documents will promptly be dispatched by courier; however, no liability can be accepted for their loss or late delivery. In addition, if requested, the documents can be dispatched electronically after presentation by the prospective tenderer of an appropriate evidence of payment of the non-refundable fee. In the event of discrepancy between electronic and hard copies of the documents, the hard copy shall prevail.

All tenders must be accompanied by a tender security of Euro 50,000 for the lot 1 and of Euro 25,000 for the lot 2 or its equivalent in a convertible currency.

Tenders must be delivered to the office at the address below on or before Tuesday, 02 September 2014 at 12:00 hrs (Podgorica, local time), at 12:30 hrs p.m. will be opened in the presence of those tenderers’ representatives who choose to attend.
