On 25.10.2019, the contracting authority signed Financing Contract No 4836, code SMIS 124108, under the name ‘Development of public transport infrastructure in Satu Mare Municipality’, which seeks to achieve three objectives, namely ‘Increasing the efficiency of public urban passenger transport through the purchase of hybrid buses and securing support infrastructure’, ‘Development of Trans-county terminal — Trans-local, construction of a depot for electric/hybrid buses as well as a charging station — Factory Street’ and ‘Building a traffic management system including video monitoring system’. Objectives of the realisation of the investment:

An integrated and efficient system for public transport management and the management of ticket sales/subscriptions;

Increased efficiency and transparency through information of public transport;

Increased passenger satisfaction, increased use of public transport;

Increase the accessibility of ticket purchase and control processes to ensure that all passengers purchase tickets/subscriptions with existing means;

The implementation of the camera system will increase the safety level and increase the sense of safety in the use of public transport.

Cf. Article 160 (2) of Act No 98/2016 as amended by Government Emergency Order No 107/2017, the contracting authority will reply to the clarifications on the 10th day before the deadline for the submission of tenders. At the same time, the number of days up to which clarifications may be requested before the closing date for submission of tenders/applications is 20 days.

In accordance with Article 193 of Law 98/2016, the contracting authority will accept, at the time of submission of the offers (Single European Achising paper), to demonstrate the qualification requirements, including the exercise capacity, as preliminary evidence.

The contracting authority is obliged to accept as sufficient and relevant to demonstrate that the tenderer/associated tenderer/subcontractor (s) do not fall under one of the situations set out in Articles 164, 165 and 167 of Law 98/2016, any document deemed instructive in this respect in the country of origin or in the country where the tenderer/partner/sponsor/third-party subcontractor is established, such as certificates or equivalent documents issued by the competent authorities of that country. Where no documents are issued in the country of origin or in the country of establishment of the tenderer/associated tenderer/subcontractor (s), such as certificates or equivalent documents issued by the competent authorities of the country concerned or those documents do not cover all the situations referred to in Articles 164, 165 and 167, the contracting authority is obliged to accept a declaration on honour or, if there is no statutory declaration in that country on the declaration on honour, a certified declaration made before a notary, an administrative or judicial authority or a professional association competent for that purpose. The SPD will also be complemented, where appropriate, by third party supporters and subcontractors, cf. Article 170 (3) of the Act. 98/2016.

According to the notification on the use of the DUAE, dated 08/04/2019, issued by ANAP: ‘For cases where the tenderer is an association of economic operators or in cases where the tenderer has subcontractors or supporters, each economic operator shall authenticate in the system and access the award procedure in order to complete the DUAE in the capacity in which it was included in that procedure (associate, subcontractor, third party supporter). All those who have to respond to the DUAE should be registered as users of the system. In the same way as at present, one of the members of the consortium or an economic operator with an individual offer shall be included and submitted to the tender procedure and the other participants shall only directly supplement the system in the system and may not modify the tender’.

Prior to the award of the contract, the contracting authority shall, for the purposes of demonstrating compliance with all qualification criteria, in accordance with the information contained in the DUAE, ask the tenderer ranked first in the interim ranking ranking at the end of the evaluation of the tenders to submit: (a) certified declaration of absence of debts in respect of the payment of taxes, levies or contributions to the consolidated general budget (local budget, state budget, etc.) at the time of submission; b) the criminal record of the economic operator and of the members of the administrative, management or supervisory body of that economic operator, or those having powers of representation, decision or control therein, as resulting from the certificate issued by the NTRO/constituent act; where appropriate, documents demonstrating that the economic operator may benefit from the derogations provided for in Article 166 (2), Article 167 (2), Article 171 of Law No 98/2016 on public procurement; D) other binding documents, as appropriate.

Economic operators submitting the tender must prove a form of registration in accordance with the law of the country of residence, so that it is clear that the economic operator is legally constituted and that he is not in one of the situations of cancellation of constitution and that he has the professional ability to perform the activities which are the subject of the contract.

In the case of participation in the procedure with a joint tender, the requirement is fulfilled if the associations have as their areas of activity those with the appropriate code for the part of the contract they are carrying out. The tert cannot support an economic operator that is a tenderer with its CAEN code, from the recital that a CAEN code belongs to its own name.

In accordance with Article 193 of Law No 98/2016, the contracting authority accepts at the time of submission of the offers (Single European Procurement Document) to the tenderer/associated tenderer/tenderer for demonstration of qualification requirements, including exercise capacity as preliminary evidence. Economic operators shall be required to complete the DUAE in the system until the closing date for the submission of tenders.

According to the notification on the use of DUAE in 08/04/2019 issued by ANAP: ‘For cases where the tenderer is an association of economic operators or in cases where the tenderer has subcontractors or supporters, each economic operator shall authenticate in the system and access the award procedure in order to complete the DUAE in the capacity in which it was included in that procedure (associate, subcontractor, third party supporter). All those who have to respond to the DUAE should be registered as users of the system. In the same way as at present, one of the members of the consortium or an economic operator with an individual offer shall be included and submitted to the tender procedure and the other participants shall only directly supplement the system in the system and may not modify the tender.’

If the tenderer ranked first is a foreign tenderer and if the foreign tenderer is unable to submit their NEBs, the requirement can also be fulfilled by submitting equivalent documents issued in the country where the bidder is resident. The documents referred to above will be accompanied by their authorised translation into Romanian by a sworn translator in accordance with the provisions of Law No 178/1997.

Prior to the award of the contract, for the Romanian tenderers the supporting documents to be submitted, at the request of the contracting authority, only by the tenderer ranked in place I in the intermediate ranking drawn up at the end of the evaluation of the tenders, are the authentic certificates issued by the NTRO, and in the case of foreign tenderers equivalent documents will be requested in the country of residence.

List and brief description of selection criteria:

For procurement contracts for goods: the execution of deliverables of the type specified in the Tender shall provide evidence of the provision, assembly, testing and putting into service of traffic management systems, over the last 3 years at the closing date set for the submission of tenders. The tenderer shall demonstrate that it has supplied, installed, tested and put into service traffic management systems that are similar to the type/nature and complexity and in terms of the outcome or functionality sought for the purpose of the contract to those subject to the object of the procurement, the beneficiaries of which are contracting authorities or private customers. The same contract will be understood to mean: contract comprising traffic management systems for a minimum of 100 buses, comprising a minimum of the following components: planning system, information system and e-ticketing.

The tenderer is required to specify the Party/Parties and the proportion of the contract which it is intended to subcontract and the dates of recognition of the proposed subcontractor, if known, at the time of submission of the offer.

Minimum level(s) of standards possibly required:

In accordance with Article 182 (1) of Law No 98/2016, as amended, the tenderer has the right to invoke the support of a third party/third party in relation to the fulfilment of the criteria relating to technical and professional capacity, regardless of the nature of the legal relations existing between the economic operator and the third party (s) concerned. Article 182 (2) provides that, with regard to the fulfilment of the criteria relating to technical and professional capacity, the tenderer may rely on the capacity of the supporter only when it actually provides the necessary products for which the qualifications are required. In this respect, the interested third parties will submit the relevant information, complementing the DUAE. In the case of association, the tenderer shall have the possibility to fulfil the requirement of similar experience by aggregating the individual or joint experience submitted by all the members of the group. To this end, all members of the group shall submit their information of interest by completing a DUAE. According to the notification on the use of the DUAE, dated 08/04/2019, issued by ANAP: ‘For cases where the tenderer is an association of economic operators or in cases where the tenderer has subcontractors or supporters, each economic operator shall authenticate in the system and access the award procedure in order to complete the DUAE in the capacity in which it was included in that procedure (associate, subcontractor, third party supporter). All those who have to respond to the DUAE should be registered as users of the system. In the same way as at present, one of the members of the consortium or an economic operator with an individual offer shall be included in the tender procedure and the other participants shall only enter the system directly in the system and shall not modify the tender.” The possibility shall be explicitly mentioned, for each contract submitted, at least the following information necessary to verify the fulfilment of the criterion: in the description, mention shall be made of: the contract name, date and number of the contract will be described as components of the contract (for example, if the contract includes: traffic management systems for at least 100 buses, if it comprises the following components: planning system, information system and mode of e-ticketing), at the same time: the value of the contract without VAT, the starting date of the contract, the date of completion and the beneficiary of the contract. the joint contracts presented individually by each of the members of an association shall be taken into account. according to the provisions of Article 193 of Law No 98/2016, as amended and supplemented, the contracting authority will accept, at the time of the submission of the tenders in accordance with Article 182 (3) and (4) of Law No 98/2016, as further amended and supplemented, the tenderer’s undertaking, together with the documents sent to him by the third party/supporter/supporter, showing the actual method by which the third party/supporter/supporter will carry out its own supporting commitment, which documents will be set out in annexes to that commitment. Before awarding the contract, the contracting authority will ask the tenderer ranked first after application of the award criterion, to submit supporting documents: copies of relevant parts of the contracts they have performed/pre-reception certificates/recommendations/certificates of performance/certificates of performance/certificates of findings, and others demonstrating that all qualification criteria are fulfilled, according to the information contained in the DUAE.

In accordance with Article 193 of Law 98/2016, the contracting authority will accept at the moment of submission of tenders from the tenderer DUAE completed which will include information on the part of the contract to be subcontracted and will have attached the subcontracting agreement. The subcontractors on whose capacity the tenderer relies will in turn supplement a separate ETD, including the information on exclusion situations as referred to in Articles 164, 165 and 167 of Law No 98/2016, as well as those relevant to the capacity building on which the bidder is based. If a subcontractor fails to meet a qualification requirement, then it will only present the CASH for the purpose of demonstrating that the subcontractor does not qualify in the grounds for exclusion. According to the notification on the use of the DUAE, of 08/04/2019 issued by ANAP: ‘For cases where the tenderer is an association of economic operators or in cases where the tenderer has subcontractors or supporters, each economic operator shall authenticate in the system and access the award procedure in order to complete the DUAE in the capacity in which it was included in that procedure (associate, subcontractor, third party supporter). All those who have to respond to the DUAE should be registered as users of the system. In the same way as at present, one of the members of the consortium or an economic operator with an individual offer shall be included in the tender procedure and the other participants shall only supplement directly in the system and shall not modify the tender”.The economic operator ranked first after applying the award criterion to the admissible tenders will prove that the qualification requirements have been met by the subcontractors by submitting supporting documents, at the request of the contracting authority. The contracting authority may reject the proposed subcontractor if he or she does not meet the capacity qualification requirements or is one of the grounds for exclusion and requests that the candidate/tenderer be replaced only once, his/her replacement and the submission of another subcontractor. Prior to the award of the contract, the contracting authority shall, in order to demonstrate that all qualification criteria are fulfilled, in accordance with the information contained in the DUAE, shall ask the bidder ranked first in the interim ranking ranking at the end of the evaluation of the tenders to submit to the nominated subcontractor the documents: (a) certified declaration of absence of debts in respect of the payment of taxes, levies or contributions to the consolidated general budget (local budget, state budget, etc.) at the time of submission; b) the criminal record of the economic operator and of the members of the administrative, management or supervisory body of that economic operator, or those having powers of representation, decision or control therein, as resulting from the certificate issued by the NTRO/constituent act; where appropriate, documents demonstrating that the economic operator may benefit from the derogations provided for in Article 166 (2), Article 167 (2), Article 171 of Law No 98/2016 on public procurement; D) other binding documents, as appropriate.

NOTE 1: The non-completion of the DUAE with the offer (including for associate/sustinence/subcontractor) triggers the rejection of the bid as unacceptable. The following documents will be lodged with the DUAE: a firm commitment by the sustinator tert from which it is the actual manner in which it takes delivery of its support, the subcontracting agreement and/or the Association Agreement, as the case may be. In order to ensure that the award procedure is properly carried out, this is necessary to request clarifications of the form of the information contained in the sections of the DUAE, both of the tenderer/candidate and of the subcontractor/sustenator, in order to ensure that the award procedure is properly carried out.

NOTE 2: If the second or more tenders are found to be in the first place as a result of the equal price tendered, the contracting authority will request through SICAP, re-tendering from the tenderers ranked first. In this respect, at the request of the evaluation committee, tenderers will submit in the SIIF within the deadline given to the financial proposal with a new price.

NOTE 3: If the tenderers had difficulties with the technical nature of the submission of the Tender in SICAP (supporting documents as evidence of the information contained in the DUAE, the documents of the technical proposal and of the financial proposal, as well as the price of the bid in the dedicated SICAP), please do not hesitate to contact the operator of the SISCAP service.

NOTE 4: If the guarantee of participation is guaranteed by the guarantee instrument issued by the insurance company, the letter of guarantee and insurance/guarantee clauses/general conditions, specific conditions signed by the insurer and insured will be provided.

Note 5: The procedure will be carried out in full by electronic means, the traceability of the actions relating to the award of public procurement contracts shall be assured by default of SICAP both during the evaluation of the tenders and before the closing date for the opening of tenders, thus all requests for clarifications will be transmitted by SICAP and the replies will also be transmitted by SICAP.

NOTE 6: Several economic operators have the right to be associated with the purpose of submitting the joint tender, without being obliged to formally bind the association. In the framework of the Association Agreement, at least the following shall be mentioned: as all of its associations, it will assume the liability and the development of the contract for the fulfilment of the contract; as the leader of the association, it is bound to force it and to have instructions on behalf of all the associations; both in the course of the procedure and in the case of the designation as a castle during the course of the contract leader is responsible in his own name and on behalf of the Association for the fulfilment of the contract; it will be compulsory to indicate the parts, i.e. the categories of works/services to be performed by each of the associations.
