Construction of a new build music and performing arts venue adjoining the Listed Dundas House on St Andrew Square. 2 Stage tender with pre-construction services agreement and NEC 4 Target cost contract. 45 000 000 GBP construction cost. Concrete and steel construction with quality internal and external finishes. Complex building services due to acoustic requirements of the auditoria.

This procurement will be conducted through the use of the restricted procedure. All queries about this procurement must be made via the PCS Portal.
The process we will apply will be:
— statements including the specific requirements can be found within Section III.1.1, III.1.2 and III.1.3 of the Contract notice,
— bidder's must pass the minimum standards sections of the ESPD (Scotland).
Where indicated responses will be scored on a pass/fail basis, and other responses will be scored in the following way:
0 — Unacceptable. Nil or inadequate response.
1 — Fails to demonstrate previous experience/capacity/capability relevant to this criterion.
2 — Poor. Response is partially relevant but generally poor. The response shows some elements of relevance to the criterion but contains insufficient/ limited detail or explanation to demonstrate previous relevant experience/capacity/capability.
3 — Acceptable. Response is relevant and acceptable. The response demonstrates broad previous experience, knowledge and skills/ capacity/ capability but may lack in some aspects of similarity e.g. previous experience, knowledge or skills may not be of a similar nature.
4 — Good. Response is relevant and good. The response is sufficiently detailed to demonstrate a good amount of experience, knowledge or skills/capacity/capability relevant to providing similar services to similar clients.
5 — Excellent. Response is completely relevant and excellent overall. The response is comprehensive, unambiguous and demonstrates thorough experience, knowledge or skills/ capacity/ capability relevant to providing similar service to similar Clients.

Economic operators may be excluded from this competition if they are in any of the situations referred to in.
Regulation 58 of the Public Contracts (Scotland) Regulations 2015.
Section III: Legal, economic, financial and technical information
Provide details of the professional qualifications of the staff in the local offices that would be involved in the construction project. Provide typical professional qualifications for staff that could be involved in project delivery on site.
Economic and Financial Standing:
ESPD Question 4B.1A The bidder should provide its (general) yearly turnover a minimum of 3 financial years. The minimum required turnover per year is 50 000 000 GBP.
ESPD Question 4B.2A The bidder should provide its yearly (specific) turnover in the business area(s) covered by the contract for a minimum of 3 fiscal years.

ESPD Question 4B.6 The Client will assess the financial health of the bidder through inspection of the last 3 years financial accounts.
ESPD Question 4B.5 Insurance:
The Bidder must confirm that they have or will commit to obtain prior to the commencement of the contract, the following levels of Insurance Cover:
— 4B.5a Professional Indemnity Insurance to the level of 20 000 000 GBP,
— 4B.5b Employer’s Liability Insurance covering the death of or bodily injuries to employees of the bidder arising out of and in the course of their employment in connection with this Contract to the level of 20 000 000 GBP,
— 4B.5c Public liability insurance covering the death of or bodily injury to a person (not an employee of the bidder) or loss of or damage to property resulting from an action or failure to take action by the bidder to the level of 50 000 000 GBP.
ESPD Question 4C.1 Technical and professional ability:
With reference to the nature and details of the works that are the subject matter of this tender, relevant examples are to be provided of works undertaken by the bidder in the last 10 years.
Bidders should also demonstrate experience where they have used the NEC suite of contracts, specifically the NEC3 or 4 engineering and construction contract, Option C Target Contract with activity schedule or contracts which have management techniques similar to those in the NEC suite of Contracts.

— training arrangements to ensure that its workforce has sufficient skills and understanding to discharge their various responsibilities,
— on-going procedures for monitoring Quality Management,
— a complaints process.
ESPD Question 4D.2 Environmental management standards:
It is a requirement of this tender that the bidder recommended for award holds the following environmental standard / accreditation: BS EN ISO14001 Environmental management systems or a documented Environmental management standard that as a minimum covers:
— environmental policy,
— environmental management procedures,
— on-going procedures for monitoring Environmental management performance,
— systems for monitoring Environmental management performance,
— waste procedures,
— environmental protection measures with suppliers.
