II.1.4)Short description:

The procuring entity intends to apply a part of financing allocated under the Ukraine Municipal Infrastructure Programme (UMIP) to eligible payments to a qualified supplier under the contract for supply of special vehicles for maintenance of water and wastewater infrastructure in Lutsk.

The scope of procurement includes three pick-up trucks, one backhoe loader, one wheeled excavator, four workshop vans, one dumper truck and one crane truck, including related services of transportation, start-up and training of operators.

Tenders shall be prepared and submitted pursuant to the requirements, procedures and forms provided in the Tender Document. The Tender Document is available upon written request to the email address of the procuring entity indicated in Section I above and payment of a non-refundable fee of EUR 100.00 (one hundred Euros) or UAH 3 300.00 (three thousand three hundred Ukrainian Hryvnia) to the bank account provided by the procuring entity in response to the request.

II.2.4)Description of the procurement:

Procurement will be conducted in accordance with the EIB’s ‘Guide to Procurement for Projects Financed by the EIB’ available at https://www.eib.org/en/publications/guide-to-procurement.

Firms originating from all countries of the world are eligible to tender for the contract. In the case of a Joint Venture, Consortium or Association (JVCA), all partners of the JVCA must be jointly and severally liable in respect of their tender. A firm or a member of a JVCA may participate in only one tender for the contract, either individually or as a partner in a JVCA. However, this does not limit the inclusion of the same subcontractors in more than one tender.

Government-owned entities of Ukraine shall be eligible only if they can establish that they (i) are legally and financially autonomous, (ii) operate under the principles of commercial law, and (iii) are not dependent agencies of the procuring entity.

The Supplier shall be required to observe with the environmental and social standards of the EIB (available at https://www.eib.org/en/publications/environmental-and-social-principles-and-standards.htm).

Tenders shall comprise all the documents, forms and covenants required by the Tender Document, including the price schedules, and shall be submitted by the deadline date set out in the Tender Document and this notice. Failure to furnish all information or documentation required by the Tender Document or submit the tender before the deadline may result in rejection of the Tender.

Section III: Legal, economic, financial and technical information

III.1)Conditions for participation
III.1.1)Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers
List and brief description of conditions:

The Tenderer should demonstrate a minimum average annual turnover of one million three hundred thousand EUR (1 300 000 Euros) equivalent over the last three (3) years, starting 1 January 2018.

The documentary evidence may be provided in the form of audited balance sheets or, if not required by the laws of the Tenderer’s country, other verified financial statements acceptable to the purchaser.

Local tenderers shall provide documentary evidence of having no deferred debts to tax authorities.

If a Tenderer is a Joint Venture (JV), all members shall meet the above financial requirement collectively with at least one partner meeting at least 50 % of the requirement.

III.1.2)Economic and financial standing
List and brief description of selection criteria:

Manufacturer of each item of the Goods must have successfully produced at least the following quantities of similar goods over the last three (3) years before the submission deadline:

• pick-up truck – at least ten (10) units;

• backhoe loader – at least ten (10) units;

• wheeled excavator – at least ten (10) units;

• workshop van – at least ten (10) units;

• dumper truck – at least ten (10) units;

• crane truck – at least ten (10) units.

If Tenderer is not a manufacturer, but is offering the Goods on behalf of the Manufacturer under Manufacturer's Authorization Form, the following criteria shall apply:

— the tenderer shall demonstrate that it has successfully completed at least two (2) contracts for supply of similar goods during the past three (3) years before the submission deadline. The tenderer shall furnish a list of largest contracts completed over the required period providing description and price of the goods, quantity and period of supply, name, address and phone/fax of the client. The purchaser may also request copies of such contracts and documentary evidence of successful completion thereof,

— if a tenderer is a Joint Venture (JV), all members shall meet the above requirements collectively.

In order to be qualified, the winning tenderer must submit documentary evidence that that it or manufacturer of each item of the Goods is/will be represented by a certified agent in Ukraine, equipped and able to carry out the aftersales (warranty and post-warranty) servicing, repair, maintenance and spare part stocking obligations required in the Tender Document. The general requirement for the aftersales servicing is maintenance and repairs of the goods in order to maintain in working condition and within the functional parameters, indicated in corresponding parts of Section V. Schedule of Requirements. It includes (but not limited by) maintenance, current repairs and repairs of mechanical, electrical and other parts of supplied equipment.
