II.1.5)Short description of the contract or purchase(s)
The purpose of this invitation to tender is to acquire services for the development, maintenance, studying and support of MS Project Server-based information systems of the European Court of Auditors. It covers, inter alia, maintenance and support (S1) of the existing information systems (IS) of the Court indicated in the tender specifications, development (S2) of new services and applications and the integration of these applications with other IS of the Court, and consultancy services (S3) in the field of information systems based on MS Project Server technologies. The following services are included: project management activities, pre-analyses, feasibility studies, prototypes/models, analysis, design, development, testing, installation, parameterisation, documentation, training, user support and coaching as well as consultancy in the field of information systems based on MS Project Server technologies.

The Court shall make the payment within 30 days from receipt of the invoice, provided the delivery has been accepted.
Payment for the services will be made in accordance with the Financial Regulation applicable to the annual budget of the European Union and the conditions outlined in the call for tender documents.
The tenderer should note that the party contracting with the Court will be responsible for the correct application of rules concerning the imposition of VAT. The European Court of Auditors is exempt from VAT in accordance with Articles 3 and 4 of the provisions of the Protocol on the privileges and immunities of the European Union.

Tenders may be submitted individually or in association with third parties. If tenders are submitted by a consortium of economic operators, all the members of the consortium must be jointly and severally liable for performance of the contract. III.2.1)Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers
Information and formalities necessary for evaluating if the requirements are met: Tenderers shall prove that they are not in the exclusion situations set out under Articles 106 and 107 of Regulation (EU, Euratom) No 966/2012 of the European Parliament and of the Council of 25.10.2012 on the financial rules applicable to the general budget of the Union and repealing Council Regulation (EC, Euratom) No 1605/2002 — hereinafter referred to as ‘the Financial Regulation’ (OJ L 298, 26.10.2012, p. 1). The tenderer to whom the contract is to be awarded shall provide specific documents in order to provide evidence that he is not in one of the exclusion situations referred to in Articles 106 and 107 of the Financial Regulation.
Legal capacity will be assessed on the basis of the following documents:
1) proof of entry on the professional or trade register under the conditions laid down by legislation in the country in which the tenderer resides;
2) a legible copy of the notice of appointment of the person(s) authorised to represent the tenderer in dealings with third parties and in legal proceedings, if it is not included in the abovementioned document.
III.2.2)Economic and financial ability
Information and formalities necessary for evaluating if the requirements are met: Tenderers must have sufficient economic and financial capacity to enable them to perform the FWC in compliance with the contractual provisions, taking into account its value and scale. If, in the light of the information supplied by the tenderer, the Court has doubts about his financial capacity, or if it is clearly insufficient for performance of the FWC, the tender may be rejected without the tenderer being able to claim any financial compensation.
In respect of the FWC which is the subject of this invitation to tender, the Court furthermore requires tenderers to have a minimum financial and economic capacity, which will be assessed on the basis of the following supporting documents:
1) balance sheets and profit and loss accounts:
— a copy of audited balance sheets or extracts from balance sheets and profit and loss accounts for the past 3 financial years for which accounts have been closed. If the balance sheets or the statements show an average loss over the past 3 financial years for which accounts have been closed, then the tenderer must furnish another document as proof of his financial and economic capacity, such as appropriate bank references or proof of professional risk insurance cover,
— proof of the publication of the financial statements where such a publication is required by national rules;
2) specific annual turnover:
— a statement of the specific annual turnover relating to the services covered by this call for tenders (development, maintenance and consultancy for Microsoft Project Server-based applications), for each of the past 3 financial years for which accounts have been closed. To this end, the tenderer shall complete an economic and financial capacity questionnaire (Annex 3 — form 6).
Minimum level(s) of standards possibly required: The average specific annual turnover relating to the services covered by this call for tenders (development, maintenance and consultancy for Microsoft Project Server-based applications) in the past 3 financial years for which accounts have been closed must be above 250 000 EUR.
III.2.3)Technical capacity
Information and formalities necessary for evaluating if the requirements are met:
Tenderers must have sufficient technical and professional capacities to enable them to perform the FWC in compliance with the contractual provisions, taking into account its value and scale. If, in the light of the information supplied by the tenderer, the Court has doubts about a tenderer's technical and professional capacity, or if it is clearly insufficient for performance of the contract, the tender may be rejected without the tenderer being able to claim any financial compensation.
The technical and professional capacity will be judged on the basis of the tenderer's expertise relevant to the required services in particular with regard to the tenderer's know-how and experience. Minimum required levels are listed in the next section.
The technical and professional capacity will be assessed on the basis of the following supporting documents:
1) a short description of the tenderer's economic activity (maximum of 5 A4 pages) including specific activities with regard to the scope of this call for tenders;
2) a description and evidence of at least 3 and maximum 5 contracts or projects performed in the last 3 years (i.e. from July 2012) for at least 3 different companies, complying with requirements stated in the next section. In order to prove this capacity, tenderers are requested to complete the form 7 in Annex 3 for each of these projects.
Where the contracts or projects are provided to contracting authorities, evidence of performance shall be in the form of certificates issued or countersigned by the competent authority;
3) a duly completed CV summary (form 8 in Annex 3 to the invitation letter);
4) a completed set of CV forms according to the type and number of profiles required above. Tenderers are requested to complete form 9 in Annex 3 to the invitation letter for each submitted CV. If the tenderer submits CVs of persons to be recruited, a declaration signed by this person confirming his intention to be recruited shall be attached. The same person can be proposed for 2 different profiles, if appropriate, but not more.
Minimum level(s) of standards possibly required:
1) Tenderer's economic activity:
— the tenderer's economic activity must be relevant to the subject of this call for tenders.
2) Evidence of at least 3 contracts or projects:
— the tenderer must prove that he has performed at least 3 projects/contracts in the last 3 years for at least 3 different companies, that cover provision of similar services to those covered by this call for tenders. The submitted projects/contracts must be relevant in terms of subject of this call for tenders (services/technologies/methodologies/tools).
Requirements concerning each submitted project/contract:
— each submitted project/contract, in order to be accepted, shall include at least one of the services S1, S2 or S3 (see point B.3 of the tender specifications).
Requirements concerning all submitted projects/contracts:
— the submitted projects, in order to be accepted, shall altogether cover at least the period of 10 man-months,
— the submitted projects, in order to be accepted, shall altogether cover at least the following services:
S1: maintenance (including corrective, evolutive and/or adaptive maintenance) and support of MS Project Server-based applications or information systems;
S2: development of information systems or applications based on MS Project Server technology in areas such as planning and/or project management and/or resource allocation and/or decision-making and/or reporting or business intelligence, etc.;
S3: coaching and/or training activities for end-users of such systems.
3) Evidence of educational and professional qualifications of the persons responsible for providing the services as indicated below (set of CV forms):
Requirements concerning the CVs:
— the proposed persons shall fulfil requirements concerning: education, professional experience and languages as specified in the corresponding profile definition in point B.6 of the tender specifications.
Requirements concerning number of CVs:
— the tenderers shall respect the minimum and maximum number of CVs to be provided per profile and level indicated in the table on p. 10 (Section A.8.3 of the tender specifications). If the tenderer presents more CVs than the maximum required, CVs will be treated according to the sequence established by the tenderer's tender, the CVs presented over the limit of required CVs for the given profile will not be taken into consideration for the selection procedure.
At least 1 CV must be provided per profile irrespective of the level.
The same person can be proposed for 2 different profiles, if appropriate, but not more.
